Regulations as to the Protection of Life and Property in Ships.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of July, 1925.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

H IS Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by clause (h) of section two hundred and thirty-four of the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following general harbour regulations which shall be in force in all ports in the Dominion.

REGULATIONS.

  1. EVERY Harbour Board shall supply and keep readily accessible on every wharf which is under its control and on or from which cargo is landed or shipped, a stretcher for use in case of accident in the hold or holds of any ship berthed thereat.

  2. The stretcher shall be constructed to the specification of the St. John Ambulance Society, and provided with slings so as to enable it to be safely lifted from the ship's hold by the ship's or shore lifting-gear, and no injured person shall be lifted by any other means.

  3. Any Harbour Board failing to comply with the requirements of these regulations shall be liable to a fine of twenty pounds.

Variation of an Order in Council prohibiting Alienation of certain Native Land.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

W HEREAS by section one hundred and thirty-two of the Native Land Act, 1909, it is enacted that any Order in Council made thereunder may be at any time varied or revoked:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vary an Order in Council dated the twenty-ninth day of September, one thousand nine hundred and twenty-four, published in the New Zealand Gazette of the second day of October, one thousand nine hundred and twenty-four, and made under the said section one hundred and thirty-two, regarding the Ahomatariki 2B and other Blocks set out in the Schedule thereto by excluding and excepting from prohibition of alienation the land called or known as Rotokautuku 2F 3A Block.

Varying a Condition as to setting back the Building-line on Portion of Ghuznee Street, in the City of Wellington, imposed by an Order in Council under Section 117 of the Public Works Act, 1905.

At the Government House at Wellington, this 29th day of June, 1925.

HIS EXCELLENCEY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Amendment Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the twenty-seventh day of May, one thousand nine hundred and seven, and published in Gazette No. 47, of the thirtieth day of May, one thousand nine hundred and seven, exempting the portion of Ghuznee Street in the City of Wellington, situated between Woolcombe Street and Willis Street, from the provisions of section one hundred and seventeen of the Public Works Act, 1905, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portion of street within a distance of thirty-three feet from the centre-line of the said portion of street, by cancelling the condition as to setting back the building-line on the northern side of the said portion of street and by varying the condition with regard to the building-line on the southern side of the said portion of street, so that no building or part of a building shall at any time be erected on the southern side of the said portion of street within a distance of sixty-six feet from the opposite side of the said portion of street, such latter condition being of the same effect as the Wellington City Building-line By-law No. 46, 1924.

Vesting Crown Land in the Whakatane County Council for Tree-planting Purposes.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of June, 1925.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section seventy of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1924, it is provided that the Governor-General may, by Order in Council, vest the land described in the said section seventy (being the land described in the Schedule hereto) in the Corporation of the County of Whakatane for tree-planting purposes, subject to such terms and conditions as may be prescribed or embodied in such Order, and subject also to the payment by the Whakatane County Council of such price (if any) as the Governor-General may determine:

And whereas the Governor-General has determined that no price should be paid in respect of the said vesting:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by the said section seventy, doth hereby declare that from and after the day of the date hereof the land described in the Schedule hereto shall become vested in the Corporation of the Chairman, Councillors, and Inhabitants of the County of Whakatane for tree-planting purposes, subject to the conditions hereinafter contained, that is to say:

  1. The Whakatane County Council shall, within six months of the date hereof, or within such extended period as the Commissioner of State Forests may decide, prepare a general forest working-plan of future operations to cover a period of not less than five years; such working-plan shall fully specify the silvicultural operations proposed to be carried on during the currency of the plan and such other matters as the Director of Forestry thinks fit.

  2. It shall not be lawful for the said Council to carry on such silvicultural operations unless and until such plan has been approved by the Commissioner of State Forests, and all such operations shall be carried on according to such plan as approved by the said Commissioner and under the supervision of the Director of Forestry.

  3. Any officer of the State Forest Service shall have free access to the said land at all times for the purpose of inspecting planting or other forestal operations, or for the purpose of reporting on proposed forest activities.

  4. The said Council shall, as soon as practicable after the date hereof, appoint some fit person to supervise and manage all tree-planting operations which may be undertaken by the said Council, and generally to advise the said Council on all matters pertaining to its forestry operations.

  5. The said Council may dispose of, by private sale, tender, or auction, any timber, trees, tree-seeds, firewood, or other forest produce on or from the said land.

  6. The payment of expenses of administration, management, and development of the said land for forestry and other purposes incidental thereto (including any expenses of supervision incurred to the State Forest Service) shall be a first charge on all moneys received therefrom, whether by way of rent, fees, proceeds of sales of forest produce, or from any other source whatsoever; and no such moneys shall be spent
