Prescribing the Rate of Interest that may be paid by the Taumarunui Borough Council in respect of a Loan of £5,000, being a Further Portion of a Loan of £32,000 authorized to be raised for constructing and improving Streets.

At the Government House at Wellington, this 25th day of May, 1925.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section eleven of the Finance Act, 1921, and its amendments, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council:

And whereas the Taumarunui Borough Council has been authorized to borrow the sum of thirty-two thousand pounds for constructing and improving streets, and is now desirous of raising the sum of five thousand pounds, being a further portion of the loan of thirty-two thousand pounds:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited eleven, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Taumarunui Borough Council in respect of the said loan of five thousand pounds shall be a rate not exceeding six per centum per annum, and the said Taumarunui Borough Council is hereby authorized to borrow the said sum of five thousand pounds accordingly.

Prescribing Particulars to be furnished to Fire Board by Owner of Property insuring outside New Zealand.

At the Government House at Wellington, this 25th day of May, 1925.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred on him by section forty-three of the Finance Act, 1924 (hereinafter referred to as “the said section”), and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the particulars to be given upon giving the Fire Board of a fire district the notification required by subsection two of the said section shall be the particulars set out in the Schedule hereto; and doth hereby declare that the form set out in the said Schedule may be used for the purpose of giving such notification as aforesaid.

PURSUANT to the provisions of section 43 of the Finance Act, 1924, I notify you that I have insured property as under:—

Conferring Special Jurisdiction on the Native Land Court.

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of May, 1925.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section twenty-five of the Native Land Act, 1909, it is enacted that in addition to the jurisdiction elsewhere in the said Act conferred upon the Native Land Court, the Governor-General may by Order in Council confer upon the Court jurisdiction in any matter or question affecting the rights of Natives in any real or personal property:

And whereas it is expedient to confer upon the Court the said jurisdiction as hereinafter appears:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned and all other powers thereunto him enabling, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby confer upon the Native Land Court jurisdiction to hear and determine as between Natives any claim, whether at law or in equity, as to the ownership or possession of a greenstone axe known as “Waikanae” and latterly in the custody or control of Wi Kahukahu, a Ngati-porou Chief (since deceased), and any claim to recover possession thereof with power and jurisdiction to make such order or orders as the circumstances of the case may require, and to enforce compliance therewith as fully and effectively as if the claim and order was one within the ordinary jurisdiction of the Court.
