Validating Proceedings in connection with the Shannon Borough
Council's Loan of £1,100 for Water-supply Purposes.
CHARLES FERGUSSON, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 4th day
of May, 1925.
Present :
THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.
WHEREAS the Shannon Borough Council proceeded by
way of special order to raise a loan of one thousand
one hundred pounds (£1,100) under section eighteen of the
Local Bodies' Loans Act, 1913, and the Municipal Corpora-
tions Act, 1920, and their respective amendments, for the
purpose of completing the undertaking of providing a water-
supply for the Borough of Shannon, for which a loan of
eleven thousand pounds was authorized by a poll of the rate-
payers of the said borough taken on the twenty-sixth day of
February, one thousand nine hundred and twenty-three (the
said loan of eleven thousand pounds having been found
insufficient to complete the said undertaking):
And whereas the proceedings in connection with the said
loan were irregular in that the notices calling the meeting to
pass the resolution by way of special order and the meeting
to confirm the said resolution did not provide for the place
of such meetings as required by section sixty-two, subsection
two, of the Municipal Corporations Act, 1920 :
And whereas the proceedings in connection with the said
loan were also irregular in that, although five full weeks
intervened between the said two meetings, the public notice
of the place and date fixed for the meeting to confirm the
resolution to make the special order authorizing the raising
of the loan and of such resolution were given only four times,
and were not given once in each full week as required by
section sixty-three, subsection (c), of the Municipal Corpora-
tions Act, 1920:
And whereas it appears that the ratepayers of the district
have not been misled by such irregularities as aforesaid, and
it is expedient to validate the same:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies' Loans Act, 1913,
and of all other powers and authorities enabling him in that
behalf, and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby order
and declare that the proceedings in connection with the said
loan shall be valid to all intents and purposes as though the
said notices had been correctly given, and as though public
notice of the place and date fixed for the meeting to confirm
the said resolution and of such resolution had been correctly
given, and that the validity of the proceedings in connection
with the said loan shall not be called in question by reason
only of the irregularities aforesaid.
