a mineral lease granted under the Mining Act, 1908, or, in the
case of any lands other than Crown lands, to the owner or
owners of the land to which the license shall relate (the word
“owner” includes any person or body corporate to whom
such owner shall have granted a lease or license to prospect
or bore for petroleum or other mineral oils or natural gas.)”

Regulations for the Election of a Member of the Wellington City
and Suburban Highways Board of Control by Payers of Fees
under Section 9 of the Hutt Road Amendment Act, 1917.

CHARLES FERGUSSON, Governor-General.

IN pursuance and exercise of the powers conferred on him
by section three of the Wellington City and Suburban
Highways Construction and Hutt Road Amendment Act,
1924, His Excellency the Governor-General of the Dominion
of New Zealand doth hereby make the following regulations
for the purposes of the election of a member of the Wellington
City and Suburban Highways Board of Control by the payers
of fees under section nine of the Hutt Road Amendment
Act, 1917.

REGULATIONS.

  1. In these regulations—
    “The Board” means the Wellington City and Suburban
    Highways Board of Control;
    “The Town Clerk” means the Town Clerk of the City of
    Wellington;
    “The said Act” means the Wellington City and Suburban
    Highways Construction and Hutt Road Amendment
    Act, 1924;
    “The Amendment Act” means the Hutt Road Amend-
    ment Act, 1917.

FIRST ELECTION OF MEMBER OF BOARD BY PAYERS OF HUTT
ROAD FEES.

  1. For the purposes of the first election of a member of
    the Board, pursuant to paragraph (c) of subsection two of
    section three of the said Act, the Town Clerk shall, on or
    before the 12th day of January, 1925, cause to be compiled a
    list containing the name and address and the vehicle regis-
    tration number of every person, firm, or corporate body who
    for the year commencing on the 1st day of April, 1924, has
    in respect of any motor-vehicle paid the fee prescribed by
    section 9 of the Amendment Act.

  2. (1.) The list prepared pursuant to the last preceding
    clause shall be open for inspection at the offices of the Wel-
    lington City Council during office hours on each day from
    the 12th day of January, 1925, until the 17th day of the same
    month, and public notice thereof shall be given by advertise-
    ment in some daily newspaper published in the City of Wel-
    lington.

(2.) During the aforesaid period the Town Clerk shall, on
application in that behalf, add to the list the name of every
person, firm, or corporate body who, by the production of
receipts or otherwise, satisfies him that the said person, firm, or
corporate body has, for the year commencing on the 1st day
of April, 1924, paid in respect of any motor-vehicle the fee
prescribed by section 9 of the Amendment Act.

(3.) The decision of the Town Clerk upon every such
application shall be final, and the list so settled by the Town
Clerk shall be the roll of electors.

  1. For the purpose of the election the Town Clerk shall be
    the Returning Officer, and his office shall be at the Town Hall,
    Cuba Street, Wellington.

  2. (1.) The Returning Officer shall by advertisement
    publicly notify in respect of the election—
    (a.) The day on which the election will be held and the
    hour on which the poll will be closed:
    (b.) The day and hour when the roll relating to the election
    will be closed:
    (c.) The day and hour when nominations will close.

(2.) Such notice shall be published in not less than three
issues of one of the daily newspapers published in the City
of Wellington.

  1. Every candidate for election shall be nominated in
    writing in the Form No. (1) in the Schedule hereto or to the
    effect thereof. The nomination shall be signed by two persons
    qualified to vote at the election, and shall be accompanied by
    the written consent of the person nominated.

  2. In the event of only one person being nominated the
    Returning Officer shall by advertisement in one of the daily
    newspapers published in the City of Wellington declare such
    person to be duly elected, and such person shall be deemed to
    be duly elected accordingly.

  3. In the event of more than one person being nominated
    the Returning Officer shall prepare and post to each elector at
    his address as appearing on the roll of electors a printed
    voting-paper in the Form No. (2) in the Schedule hereto.

  4. (1.) No elector shall have more than one vote.
    (2.) Where the elector is a firm or body corporate the vote
    may be exercised by any member of the firm or by any person
    appointed under the seal of the body corporate to exercise
    such vote.
    (3.) No person who exercises a vote on behalf of any firm
    or body corporate shall be debarred from voting on his own
    behalf if he himself is qualified to vote as an elector.

  5. (1.) The elector shall exercise his vote by drawing a
    line through the name of every candidate for whom he does
    not intend to vote, and shall thereupon sign the voting-paper.
    (2.) The voting-paper shall be placed in a sealed envelope
    and shall either be delivered or posted to the Returning
    Officer.

  6. (1.) If delivered to the Returning Officer the voting-
    paper must be so delivered before the day of the election or
    not later than 4.30 o'clock in the afternoon of that day, and
    if posted to him, must be posted on or before that day.
    (2.) The envelope containing any voting-paper as aforesaid,
    whether posted or delivered to the Returning Officer, shall
    be addressed:-
    "The Returning Officer for the Wellington City and
    Suburban Highways Board of Control Election, Town
    Hall, Wellington."

  7. The poll shall close at 4.30 o'clock in the afternoon of
    the day of the election. All voting-papers posted to the
    Returning Officer within the time prescribed by the last
    preceding clause shall be included and counted if received
    by him in due course of post before the close of the third day
    after the day of the election, but not otherwise.

  8. A voting-paper shall be informal in any of the following
    cases, that is to say-
    (a.) If it is not duly signed by the elector or if the number
    of voting-papers signed by him exceeds one; or
    (b.) If the elector leaves the name of more than one candi-
    date uncancelled; or
    (c.) If, being personally delivered to the Returning Officer,
    it is not delivered at his office before the close of
    the poll; or
    (d.) If, having been forwarded by post, it is not received
    at the office if the Returning Officer before the
    fourth day after the day of the election, or if, from
    the post-mark on the envelope or otherwise, the
    Returning Officer is satisfied that it was not posted
    until after the day of the election.

  9. On the fourth day after the day of the election the
    Returning Officer shall open and examine all voting-papers
    duly delivered to him or received by him through the post as
    aforesaid, and, after rejecting all informal voting-papers, shall
    ascertain the candidate who has received the greatest number
    of votes, and shall declare such candidate to be elected.

  10. Forthwith after the completion of the election the
    Returning Officer shall notify in a newspaper published in
    the City of Wellington and in the New Zealand Gazette the
    name of the person elected and the date of his taking office as
    a member of the Board.

SUBSEQUENT ELECTIONS.

  1. (1.) Not less than fourteen clear days before any
    election after the first, to be held for the purposes of para-
    graph (e) of subsection (2) of section 3 of the said Act, the
    Returning Officer shall, by advertisement in a newspaper
    published in the City of Wellington, publicly notify the day
    of the election, and shall in such notice call for the nomination
    of candidates on or before a date to be named therein, but
    not earlier than ten days after the date of the first such
    advertisement.

(2.) The foregoing provisions of these regulations, as to the
compilation of the roll and the conduct of the election, shall,
so far as applicable, apply to every such election.
