Orders in Council




Order in Council by the addition to the First Schedule of the said Order in Council of the names of the Borough Councils set out in the Schedule hereto; and doth hereby declare that the regulations set forth in the Second Schedule to the said Order in Council shall take effect as by-laws and be in force as from the date of this Order in the districts of the several Borough Councils mentioned in the Schedule hereto:

The South-eastern Side of Portion of Woolcombe Street, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 16th day of March, 1925.
Present :
THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the fifteenth day of December, one thousand nine hundred and twenty-four, viz. :-
"The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the south-eastern side of all that portion of Woolcombe Street beginning at the south-western boundary of Lot 2, provisional D.P. 6928, and extending for a distance of 133.25 links, being portion of road fronting part Town Section 110, City of Wellington";
subject to the condition that no building or part of a building shall at any time be erected on the south-eastern side of the portion of Woolcombe Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Woolcombe Street, abutting on Lots 1 and 2, provisional D.P. 6928, being part Town Section 110, City of Wellington. As the said portion of street is more particularly delineated on the plan marked P.W.D. 61725, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

The Northern Side of Portion of Sylvan Avenue, in the Borough of Mount Eden, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

"The Mount Eden Borough Council, having control of Sylvan Avenue, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that part of the street opposite Sections 1, 2, 3, 4, 5, 6, 7" ;
subject to the condition that no building or part of a building shall at any time be erected on the northern side of the portion of Sylvan Avenue (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the North Auckland Land District, Borough of Mount Eden, known as Sylvan Avenue, fronting Lots 1, 2, 3, 4, 5, 6, and 7 of part Allotment 1, Section 10, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 59913, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Licensing T. M. Lane and Sons (Limited) to use and occupy a Part of the Foreshore of Whangaroa Harbour as a Site for Three Stores and a Boat-shed.

At the Government Buildings at Wellington, this 16th day of March, 1925.
Present :
THE HONOURABLE SIR FRANCIS BELL PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the second day of February, one thousand nine hundred and eleven, and published in the New Zealand Gazette No. 11, of the ninth day of the same month, William R. Lawrence and Co. was, inter alios, licensed to occupy a part of the foreshore and land below low-water mark of Whangaroa Harbour for the purpose of using and maintaining thereon three stores and a boat-shed, erected in accordance with plans marked M.D. 2294, and deposited in the office of the Marine Department at Wellington, for a period of fourteen years from the first day of January, one thousand nine hundred and eleven :
And whereas the said license was, with the consent of the Minister of Marine, transferred to Messrs. T. M. Lane and Sons (Limited), (who with its successors and assigns is hereinafter called "the company") :
And whereas the said license has expired, and the company has made application for a fresh license under the Harbours Act, 1923 (hereinafter called "the said Act"), for a further term of fourteen years, computed from the expiry of the term of the said last-mentioned license, and it is expedient to grant the same for the term and subject to the conditions hereinafter expressed :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the company as aforesaid ; and, in further pursuance and exercise of the said power and authority, and by and with the like advice and consent as aforesaid, doth hereby license and permit the company to use and occupy that part of the foreshore, and of the land below low-water mark immediately contiguous thereto, which is particularly shown and delineated on the plans so deposited as aforesaid, for the purpose of using the aforesaid stores and boat-shed in connection therewith, such license to be held and enjoyed by the company upon and subject to the terms and conditions set out in the Schedule hereto.

SCHEDULE.

  1. In these conditions the term-
    "Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides :
    "Low-water mark" means low-water mark at ordinary spring tides :
    "Minister" means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.
