Order in Council prohibiting the use of Seine Nets for taking Fish within the Firth of Thames, and also upon Trawling-vessels.

ORDER IN COUNCIL.

At the Government House at Wellington, this 1st day of December, 1924.

Present :

HIS EXCELLENCY THE ADMINISTRATOR PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the twenty-second day of December, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette No. 24 of the twenty-fourth day of January following, certain regulations were made prohibiting the use of the purse-seine net for taking fish within the area therein described in the said Order in Council, and prescribing that it shall be unlawful to convey a purse-seine net on any vessel while such vessel is engaged in trawling :

And whereas it is desirable to revoke the said regulations, and to make others in lieu thereof :

Now, therefore, His Excellency the Administrator of the Government of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations made by the hereinbefore-recited Order in Council, and doth make the following regulations in lieu thereof.


REGULATIONS.

  1. No person shall use a Danish seine net or a purse-seine net of any description whatsoever for taking fish within that area of the Firth of Thames inside a straight line drawn from Deadman Point to the light known as “Ponui Passage Light” and a straight line from the said light to Raukura Point, as the said area is more particularly shown and delineated in red on plan marked M.D. 5779, and deposited in the office of the Marine Department at Wellington.

  2. It shall be unlawful to use or convey a Danish seine net or a purse-seine net of any description whatsoever on any vessel while such vessel is engaged in trawling.

  3. Any person committing a breach of either of the above regulations is liable to a fine of fifty pounds.

The North-western Side of Portion of Ligat Place, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 1st day of December, 1924.

Present :

HIS EXCELLENCY THE ADMINISTRATOR PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the thirteenth day of November, one thousand nine hundred and twenty-four, viz :—

“ That the Auckland City Council, having control of Ligat Place, in the City of Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that part of the said street fronting part Lot 28 and part Lot 29 of Allotments 13 and 14, Section 3, Suburbs of Auckland ” ;

subject to the condition that no building or part of a building shall at any time be erected on the north-western side of the portion of Ligat Place (described in the Schedule hereto), within a distance of twenty-five feet from the centre-line of the said portion of street.


SCHEDULE.

THE north-western side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Ligat Place, fronting part Lots 28 and 29 of Allotments 13 and 14, Section 3, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 60432, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.
