Timber in Taranaki Land District for Sale by Public Auction.
—8,974,877 Superficial Feet.

District Lands and Survey Office,
New Plymouth, 15th October, 1924.

NOTICE is hereby given that the right to cut and remove the timber on the undermentioned land will be offered for sale by public auction at the District Lands and Survey Office, New Plymouth, on Wednesday, the 26th day of November, 1924, at 2.30 o’clock p.m., under the provisions of the Land Act, 1908, and the timber regulations thereunder.

SCHEDULE.

TARANAKI LAND DISTRICT.

SECTIONS 12, 13, 14, and 23, Block III, Piopiotea West Survey District: Area, 1,348 acres. Situated on the Motutara Road about six miles and a half from Taumarunui. Access by Wanganui River Road. The block is well adapted for an easy-milling proposition as the country is easy and falls uniformly towards the main outlet; the timber is close.

Estimated quantities in superficial feet: Kahikatea, 5,665,170; rimu, 1,745,223; totara, 908,922; matai, 591,736; miro, 63,826.

Upset price: £11,500.

Time for removal of timber: Six years from date of sale, subject to an extension under clause 88 of the timber regulations.

Conditions of Sale.

  1. The right to cut and remove the timber will be sold generally in accordance with the provisions of the Land Act, 1908, the timber regulations made thereunder, and the following conditions, and may contain such additional conditions as the Commissioner in his discretion considers necessary in the interests of the Crown or of the public.

  2. The quantities of the various timbers set forth in the above Schedule are approximate only, and are furnished for the information of intending purchasers, who are expected, previous to the sale, to make their own estimate of the quantity of timber. No contract for purchase shall be voidable, nor shall the licensee be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind as stated herein; nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein.

  3. The successful bidder shall purchase the whole of the timber, and shall, on the fall of the hammer, pay in cash a deposit of 5 per centum of the amount bid, together with £1. 1s. license fee, and shall also deposit five promissory notes each for one-fifth of the balance, each payable on demand and endorsed by two persons to be approved by the Commissioner. These promissory notes will be presented, the first at an interval of twelve months from the date of sale and the others at subsequent intervals of twelve months, but they may be presented for payment at earlier dates if more than a due proportion of timber is found to be cut, or should any breach of the conditions occur, or if in the opinion of the Commissioner the interest of the Crown is jeopardized.

  4. The licensee shall have the right to cut only such kahikatea, rimu, totara, matai, and miro as can be milled; and shall have no right to the use of the land, to cut posts, &c., or firewood.

  5. The licensee shall have the right to construct and use such tramway or tramways as may be found necessary to the proper milling and removal of the timber.

  6. The timber shall be cut in a face from such areas and in such order as the Commissioner may arrange, and the Crown reserves the right of following up the mill-workings by felling and grassing such areas as from time to time will have been cleared of milling-timber, or of disposing of the land. Sufficient timber shall be left for fencing and general farming purposes.

  7. The licensee shall not put, throw, or place, or allow to be put, thrown, or placed into any river, stream, watercourse, or into any place where it may be washed into any river, stream, or watercourse any sawdust or sawmill-refuse.

  8. If the timber is unsold at auction, the right to cut it at the upset price will remain open for application until further notice.

  9. No compensation will be given, nor shall any be claimed, for any error, discrepancy, or misdescription whatever, in respect of the timber or in these conditions.

  10. All the timber, whether standing or felled or in logs, shall remain the property of the Crown until all the instalments are paid.

  11. Should any dispute arise as to boundaries, the decision of the Commissioner of Crown Lands shall be final and conclusive.

  12. If at any time during the currency of this license, the Crown Lands Ranger or other person duly authorized by the Commissioner of Crown Lands shall report, or it otherwise appears, that the timber on the said area is being improperly cut or that the interests of the Crown or settlers are prejudiced, or for any other reason, the Commissioner of Crown Lands may, by notice in writing to the licensee or his surety, suspend his license pending investigation, and the Commissioner may cancel such license if it is found that its conditions have been infringed, without prejudice to any proceeding for damage done, recovery of amounts due on royalty or otherwise.

Timber in North Auckland Land District for Sale by Public Tender.

North Auckland District Lands and Survey Office,
Auckland, 15th October, 1924.

NOTICE is hereby given that written tenders for the purchase of the undermentioned milling-timber will be received at the North Auckland District Lands and Survey Office, Auckland, up to 4 o’clock p.m., on Thursday, 20th November, 1924, under the provisions of the Land Act, 1908, and the timber regulations thereunder.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.—MANGONUI COUNTY.

SECTIONS 117 and 118, Maungataniwha Parish (Education Reserves).

489 rimu trees, containing .. 514,655 board feet.
148 totara trees, containing .. 71,443 ,,

Terms of Payment.

The sum of one-fourth of the amount of tender to be paid in cash within seven days after acceptance of tender, together with £1 1s. license fee; balance payable in three equal instalments on 1st April, 1925, 1st October, 1925, and 1st April, 1926.

All instalment-payments shall bear interest at the rate of 5 per cent. per annum as from the date of acceptance of tender, and with the interest added shall be secured by “on demand” promissory notes endorsed by two approved sureties, and such bills are to be completed and lodged with the Commissioner of Crown Lands within fourteen days after notifying the purchaser to complete.

Tenders must be accompanied by a deposit of 5 per cent. on the amount of tender in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, in terms as stated above.

Conditions of Sale.

  1. Intending purchasers are expected to visit the locality and to satisfy themselves in every particular on all matters relating to the sale.

  2. The right is reserved to the Commissioner of Crown Lands to withdraw this timber from sale either before or after the date for receipt of tenders.

  3. The aforementioned quantities, qualities, and kinds as to the said timber shall be taken as sufficiently accurate for the purpose of this sale, and no contract for purchase shall be voidable, nor shall the successful purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein, or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if the said quantity of timber is found to be in excess of that stated herein.

  4. All timber, whether standing, felled, or in logs, shall remain the property of the Crown until all the instalments are paid.

  5. The quantities stated are standing measurements, and only those trees bearing the special distinguishing brands shown are included in this sale. All trees branded F.R. or unbranded, being the undersized, defective, and isolated trees, are excluded from this sale, and must not be felled or removed.
