Declaring Portions of Road in Block IV, Te Tumu Survey District, to be Government Roads.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of September, 1924.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government roads.

SCHEDULE.

APPROXIMATE areas of the pieces of road declared to be Government roads:—

2 1 16 Adjoining Papamoa 3B 1 and Section 1.
1 1 7 „ Hikutawatawa No. 1 and Section 2.

Situated in Block IV, Te Tumu Survey District (Auckland R.D.). (S.O. 23184.)

In the Auckland Land District; as the same are more particularly delineated on the plan marked P.W.D. 59719, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.

Regulations under the War Regulations Act, 1914, amended.

ORDER IN COUNCIL.

At the Government House at Wellington, this 22nd day of September, 1924.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by clause four of the war regulations of the twenty-second day of February, 1916, made under the authority of the War Regulations Act, 1914, it is provided that no executor, administrator, or trustee of the estate of any deceased person shall without the consent of the Attorney-General distribute or pay any part of the assets or proceeds of that estate to any beneficiary or creditor who is an alien enemy or to any other person on his behalf:

And whereas by section four of the War Regulations Continuance Act, 1920, it is enacted that the war regulations set out in the Second Schedule of such Act (included wherein is the said clause four of the war regulations of the twenty-second day of February, one thousand nine hundred and sixteen) should continue in force until revoked by the Governor-General in Council:

And whereas by section six of such last-mentioned Act it is enacted that the Governor-General in Council may from time to time amend or extend any of the regulations set out in the said Second Schedule thereto for the purposes of giving full effect to the intent and purport of those regulations, but not further or otherwise, and that the War Regulations Act, 1914, should apply to any amendment or extension in the same manner as it applied to the said regulations:

And whereas it is now deemed expedient to amend the foregoing clause four in manner hereinafter appearing:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section six of the War Regulations Continuance Act, 1920, and of all other powers and authorities enabling him in that behalf, and acting by and with the consent of the Executive Council of the said Dominion, doth hereby amend clause four of the aforesaid war regulations of the twenty-second day of February, one thousand nine hundred and sixteen, as continued in force by the War Regulations Continuance Act, 1920, by adding thereto the following words, namely: “Provided that no beneficiary or creditor shall for the purposes of this clause be deemed to be an alien enemy if the deceased person in respect of whose estate he is a beneficiary or creditor shall have died subsequent to the coming into force of the Treaty of Peace with the State of which such beneficiary or creditor was at any time theretofore a subject.”

Electric Line Regulations.—Telephone Exchange Rates.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of September, 1924.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated and gazetted the seventeenth day of September, one thousand nine hundred and twenty-three, regulations were made and rates and charges fixed under the authority of the Post and Telegraph Act, 1908, and its amendments (hereinafter termed “the said Act”) for connections with telephone exchanges:

And whereas it is expedient to amend such regulations and rates and charges in the manner hereinafter set forth:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities in that behalf enabling him, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke regulation numbered 85, under the heading “Extension telephones and Miscellaneous Equipment,” in the Schedule to the above-recited Order in Council, and in lieu thereof doth hereby make the regulation set forth in the Schedule hereto, and doth declare that the regulation hereby made shall form part of and be read together with the regulations first herein mentioned, and shall come into force on and after the date of the publication of this Order in Council in the New Zealand Gazette.

SCHEDULE.

  1. THE term “same premises” is held to cover various buildings detached from one another, but on the same section of land as the main premises, and part of the same establishment. The Secretary may, however, authorize, in special circumstances, the installation of extension stations involving wires crossing a public street or road or another person’s property.

The North-eastern Side of Portion of Leven Street, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 29th day of September, 1924.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the tenth day of September, one thousand nine hundred and twenty-four, viz. :—

“That the Council of the City of Dunedin hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the north-eastern side of that street in the City of Dunedin, known as Leven Street, where the same abuts on part of Allotment 3, Block VI, Township of Roslyn, as the said portion of the said street is more particularly shown by red colour on the plan hereunto annexed ”; subject to the condition that no building or part of a building shall at any time be erected on the north-eastern side of the portion of Leven Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Leven Street, abutting on part Allotment 3, Block VI, Township of Roslyn. As the same is more particularly delineated on the plan marked P.W.D. 60768, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured pink.
