by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the 15th day of November, 1923, viz. :—

“That the Auckland City Council, having control of Fernleigh Street, Auckland, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the said street fronting portion of Lot 2 of a subdivision of Lots 26, 28, 29, and 42, of Allotment 20, Section 8, Suburbs of Auckland ”;

subject to the condition that no building or part of a building shall at any time be erected on the north-western side of the portion of Fernleigh Street (described in the Schedule hereto), within a distance of twenty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Fernleigh Street, fronting Part Lot 2, D.P. 3197, part of Allotment 20, Section 8, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 58501, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

The Western Side of Portion of Mana Road, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 4th day of March, 1924.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

I N pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twenty-ninth day of November, one thousand nine hundred and twenty-three, viz. :—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the western side of Mana Road fronting Lots 352 and 353, D.P. 52, and Revised Plan 36/3A, for a distance of 266·97 links ;”

subject to the condition that no building or part of a building shall at any time be erected on the western side of the portion of Mana Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Mana Road, abutting on Lots 352 and 353, D.P. 52. As the said portion of street is more particularly delineated on the plan marked P.W.D. 58829, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Prescribing the Term for which the Taranaki Electric-power Board may borrow the Sum of £100,000, being a Portion of a Loan of £350,000 authorized to be raised for constructing Electric Works and Reticulation.

ORDER IN COUNCIL.

At the Government House, at Wellington, this 4th day of March, 1924.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

W HEREAS by section eleven of the Finance Act, 1921, and its amendments, it is provided that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term, as may be prescribed by the Governor-General by Order in Council :

And whereas the Taranaki Electric-power Board has been authorized to borrow the sum of three hundred and fifty thousand pounds for constructing electric works and reticulation, and is now desirous of borrowing one hundred thousand pounds, being a portion of the loan of three hundred and fifty thousand pounds :

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section eleven, and it is desired that the term for which the said one hundred thousand pounds may be borrowed be thirty-six and a half years, and the rate of interest payable thereon be not exceeding six per centum per annum :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Taranaki Electric-power Board may borrow the said sum of one hundred thousand pounds shall be thirty-six and a half years, and the rate of interest that may be paid shall be not exceeding six per centum per annum, and the said Taranaki Electric-power Board is hereby authorized to borrow the said sum of one hundred thousand pounds on these terms.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section eleven, and it is desired that the term for which the said five thousand pounds may be borrowed be twenty years, and the rate of interest payable thereon be not exceeding six per centum per annum :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the term for which the Tamahere Road Board may borrow the said sum of five thousand pounds shall be twenty years, and the rate of interest payable thereon shall be a rate not exceeding six per centum per annum, and the said Tamahere Road Board is hereby authorized to borrow the said sum of five thousand pounds on these terms.
