The Northern Side of Portion of Leach Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 12th day of February, 1924.

In pursuance and exercise of the powers conferred by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the 10th day of December, 1923, viz:—
"That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen, subsection one, of the Public Works Act, 1908, shall not apply to that portion of the northern side of Leach Street to which Section 1534, New Plymouth, has frontage";
subject to the condition that no building or part of a building shall at any time be erected on the northern side of the portion of Leach Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The northern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Leach Street, abutting on Section 1534, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 58704, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

"The Devonport Borough Council; having control of that street known as Grey Street, by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the said street fronting Lots 45, 46, and 47 of Allotment 19, Section 2, Parish of Takapuna";
subject to the condition that no building or part of a building shall at any time be erected on the western side of the portion of Grey Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The western side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Grey Street, fronting Lots 45, 46, and 47 of Allotment 19, Section 2, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 58264, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Vesting the Control of a Scenic Reserve in the Katikati Hot Springs Scenic Board.
JELLICOE, Governor-General.
In pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto (being land reserved under the said Act), for the period of three years from the date hereof (unless previously altered or revoked under the said Act) in the undermentioned persons, namely,—
George Francis Pritt,
Walter Oswald Burgess,
Norman Blomquist,
Noble Johnston,
Frederick Kendall,
Arthur Edward Putt, and
Hugh Wallis,
who are hereby constituted for that purpose a special Board by the name of the Katikati Hot Springs Scenic Board (herein referred to as “the Board”), in trust, for the preservation of scenery and with the powers and subject to the conditions hereinafter contained, that is to say,—

The first meeting of the Board shall be held on Saturday, the first day of March, one thousand nine hundred and twenty-four, at two o'clock p.m., in the Show-shed, Katikati, and thereafter the Board shall meet for the transaction of business on the first Saturday in each quarter at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days' notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

The Board shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.
