Validating Proceedings in connection with the Raising of a Loan of £5,000 by the Blenheim Borough Council for Gasworks Mains Extension Purposes.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 9th day of March, 1923.

WHEREAS the Blenheim Borough Council lately proceeded to raise a loan of five thousand pounds, under the Local Bodies' Loans Act, 1913, for the purpose of extending the gasworks mains within the said borough:

And whereas the proceedings in connection with the said loan were irregular, in that the poll of ratepayers was not taken not less than one week after the day of the last publication of the notice of intention to raise the loan, as required by subsection two of section ten of the Local Bodies' Loans Act, 1913:

And whereas it appears that the ratepayers of the district have not been misled by such irregularity as aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies' Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the said poll of ratepayers had been taken at the proper time, and that the validity of the proceedings in connection with the said loan shall not be called in question by reason only of the irregularity aforesaid.

Making Regulations for licensing Seal-fisheries.

IN pursuance and exercise of the power and authority conferred upon him by section forty-two of the Fisheries Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations governing the issue of licenses to take seals within the area hereinafter described; and doth hereby order that such regulations shall have force and effect on and from the date of the gazetting hereof.

REGULATIONS.

1. In these regulations—
   "Minister" means the Minister of Marine":
   "Licensee" means the person, firm, or company to whom a license under these regulations is issued.

2. The area within which these regulations shall apply shall be as follows: All that area of tidal land between high- and low-water mark of ordinary spring tides, being the foreshore of the island known as Campbell Island, together with the foreshore of any islets or rocks within the territorial waters of the said island.

3. Licenses to take seals may be granted by the Minister and shall be for a period of one year from the date thereof, and shall be in the form set forth in the Schedule hereto, and may be revoked by the Minister at any time;

4. No seals shall be taken under any such license during the period from the 1st day of October in any one year of the period in respect of which the license is issued until the 31st day of May in the following year.

5. No female seals whatever, and no bull seals under the age of one year, shall be taken by the licensee.

6. The licensee shall not take more than four hundred bull seals in any one year.

7. The licensee shall deliver all skins taken in pursuance of his license to the Collector of Customs at a port in New Zealand to be named by the Minister, to be held by such Collector until disposed of by the licensee, and shall pay to the Collector of Customs, as a royalty, the sum of £1 in respect of each skin taken.

8. The skins of all seals taken under this license shall be delivered entire to the Collector of Customs, and shall not be cut in any way other than is necessary for the purpose of detaching the skin from the carcase.

9. No skins shall be exported from New Zealand or otherwise disposed of by the licensee without the permission in writing of the Collector of Customs to whom the skins are delivered pursuant to clause 7 hereof.

10. The licensee shall enter into a bond of £500, with approved sureties, as a guarantee of the due performance of the terms, conditions, and restrictions of his license and of these regulations.

11. The licensee shall take all steps necessary to prevent any other person, except those specifically employed by him for the purpose, from taking seals within the area hereinbefore prescribed, during the period in respect of which this license is issued.

SCHEDULE.

Under the Fisheries Act, 1908.

LICENSE TO TAKE SEALS.

In pursuance of section 42 of the Fisheries Act, 1908, and the regulations thereunder, I, , Minister of Marine, do hereby authorize , of , to take seals for a period of one year from the date of this license on all that area of tidal land between high- and low-water mark of ordinary spring tides, being the foreshore of the island known as Campbell Island, together with the foreshore of any islets or rocks within the territorial waters of the said island.

This license is issued subject to the provisions of Part I of the Fisheries Act, 1908, and of the regulations made thereunder.

Varying Close Season for Seals.

WHEREAS by Order in Council made under section five of the Fisheries Act, 1908, on the fifth day of August, one thousand nine hundred and nineteen, and gazetted on the fourteenth day of the same month, the close season for seals throughout New Zealand was extended for a period of three years from the twenty-seventh day of November, one thousand nine hundred and nineteen:

And whereas by Order in Council dated the ninth day of January, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette No. 5, of the eighteenth day of the same month, the said close season was further extended for a period of three years from the twenty-seventh day of November, one thousand nine hundred and twenty-two:

And whereas it is deemed expedient to vary the close season as so extended:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section five of the Fisheries Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the close season as so extended shall not apply to that part of New Zealand known as Campbell Island; and doth hereby further declare that this Order in Council shall take effect as from the eleventh day of March, one thousand nine hundred and twenty-two.
