Appointing Members of the First and Second Divisions of the Court of Appeal.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of March, 1923.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS by section five of the Judicature Amendment Act, 1913, it is enacted that the Court of Appeal shall consist of two Divisions to be called respectively the First Division and the Second Division of the Court of Appeal; and that each Division shall consist of five Judges of the Supreme Court, to be appointed to that Division by the Governor-General in Council:
And whereas the power conferred by the said Act upon the Governor-General in Council of appointing Judges as members of either Division, or of revoking any such appointment, shall be exercisable on the recommendation of not less than three Judges of the Supreme Court (of whom the Chief Justice shall be one), and not otherwise:
And whereas the Right Honourable the Chief Justice, the Honourable Mr. Justice Hosking, and the Honourable Mr. Justice Reed have recommended that the two Divisions of the Court of Appeal shall be constituted as shown hereafter:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Apportionment of Representation on the Thames Valley Electric-power Board.

IN pursuance and exercise of the powers and authorities conferred upon him by the Electric-power Boards Act, 1918, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby determine with respect to the Thames Valley Electric-power District, being an electric-power district duly constituted by Proclamation dated the eighteenth day of December, one thousand nine hundred and nineteen, and published in the New Zealand Gazette No. 1, of the eighth day of January, one thousand nine hundred and twenty, that the number of representatives of each constituent district on the Board of the said district, on and after dates of the next general elections of members of the Thames Valley Electric-power Board, shall be the number specified in the second column of the Schedule hereto opposite the name of that constituent district.

Authorizing the Minister of Public Works to erect, construct, provide, and use certain Works, Appliances, and Conveniences in connection with the Utilization of Water-power from the Mangahao and Tokomaru Rivers, situated in the Land District of Wellington, for the Generation, Storage, Transmission, Distribution, and Sale of Electrical Energy, in terms of Section 272 of the Public Works Act, 1908.

IN pursuance and exercise of the powers vested in him by section two hundred and seventy-two of the Public Works Act, 1908, as amended by section six of the Public Works Amendment Act, 1910, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Minister of Public Works, within the Land District of Hawke’s Bay, to erect, construct, provide, and use such works, appliances, and conveniences as may be necessary in connection with the utilization of water-power from the Mangahao and Tokomaru Rivers for the generation and storage of electrical energy, and with the transmission, use, supply, and sale of electrical energy when so generated; also to use electrical energy so generated in the construction, working, or maintenance of any public work, or for the smelting, reduction, manufacture, or development of ores, metals, or other substances; also to erect poles on private land, and carry wires over or along any such land without being bound to acquire the same, and with right of way to and along all such works and erections; and also to supply and sell electrical energy, and recover moneys due for the same.

Authorizing the Morrinsville Borough Council to erect a Monument in Morrinsville as a Permanent War Memorial.

At the Government Buildings at Wellington, this 9th day of March, 1923.

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
IN pursuance and exercise of the power and authority conferred upon him by section fifteen of the Finance Act, 1919 (hereinafter referred to as “the said section”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve the provision by the Morrinsville Borough Council of a monument as a permanent war memorial, as provided by the said section; and, with the like advice and consent, doth hereby approve of the erection of such monument in that portion of the Borough of Morrinsville, described in the Schedule hereto.

ALL that area in the Auckland Land District, part of Motumaho No. 2 Block, containing 5 acres 0 roods 9·2 perches, more or less, and being Lot 2 on the plan numbered 16037 deposited in the office of the District Land Registrar at Auckland.
