Prescribing the Rate of Interest that may be paid by the Invercargill Borough Council in respect of a Loan of £11,000 authorized to be raised for repaying a Mortgage Debt on the Lands vested in the Corporation of the Borough of Invercargill by the Invercargill Athenæum Act, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS section eleven of the Finance Act, 1921, as amended by section six of the Local Bodies’ Loans Amendment Act, 1921, provides that, notwithstanding anything to the contrary in any Act or in any rule of law, where a local authority or public body has been authorized before the passing of the said Act, or is thereafter authorized, to borrow money, whether pursuant to a poll of ratepayers or otherwise howsoever, whether the rate of interest or the term of years of the loan was or was not specified or determined, and such money or any part thereof has not been borrowed, the local authority may, with the precedent consent of the Minister of Finance, borrow such money, or such amount thereof as has not been borrowed, at such rate of interest, or for such term not less than ten years, as may be prescribed by the Governor-General by Order in Council:

And whereas the Invercargill Borough Council has been authorized to borrow the sum of eleven thousand pounds for repaying a mortgage debt on the lands vested in the Corporation of the Borough of Invercargill by the Invercargill Athenæum Act, 1916:

And whereas the Minister of Finance has given his precedent consent as required by the above-recited section eleven, and it is desired that the rate of interest at which the money may be borrowed be not exceeding six per centum per annum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the rate of interest that may be paid by the Invercargill Borough Council in respect of the said loan of eleven thousand pounds shall be a rate not exceeding six per centum per annum, and the said Invercargill Borough Council is hereby authorized to borrow the said sum of eleven thousand pounds accordingly.

Revocation of Naturalization of Wilhelm Rambaum annulled.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of October, 1922.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS letters of naturalization were issued to Wilhelm Rambaum on the twenty-seventh day of February, one thousand nine hundred:

And whereas by Order in Council under the Revocation of Naturalization Act, 1917, dated the eighteenth day of June, on thousand nine hundred and eighteen, and gazetted on the twenty-seventh day of June in that year, the naturalization of the said Wilhelm Rambaum was, with that of other persons revoked:

And whereas it is deemed expedient to annul such Order in Council in so far as it relates to the said Wilhelm Rambaum:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Revocation of Naturalization Act, 1917, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said Order in Council of the eighteenth day of June, one thousand nine hundred and eighteen, is hereby annulled in so far as it relates to the revocation of the naturalization of Wilhelm Rambaum.

Validating Proceedings in connection with a Loan of £3,000 proposed to be raised by the Kaikohe Town Board.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of October, 1922.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Kaikohe Town Board, acting under and in pursuance of the Local Bodies’ Loans Act, 1913, proposes to raise a loan of three thousand pounds for the purpose of kerbing, channelling, and top-dressing certain streets:

And whereas section ten of the said Act provides that the poll of the ratepayers shall be taken not less than one nor more than three weeks after the day of the last publication of the notice of intention to raise the loan:

And whereas the poll of ratepayers was not taken not less than one week after the day of the last publication of the said notice:

And whereas the hours of polling were in accordance with section seventeen of the Municipal Corporations Act, 1920, instead of in accordance with section seventeen of the Local Elections and Polls Act, 1908:

And whereas it appears that the ratepayers have not been misled by the said irregularities or defects, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though the poll of ratepayers had been taken in the proper manner, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularities or defects aforesaid.

Vesting the Control of a Reserve in the Mauriceville County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 24th day of October, 1922.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart for gravel purposes: And whereas it is expedient that the control of the said reserve should be vested in the Mauriceville County Council:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section two of the Public Reserves and Domains Amendment Act, 1914, doth hereby vest the control of the said reserve in the Mauriceville County Council, subject, however, to the following conditions:—

(1.) The said Council shall forthwith securely fence the gravel-pit and also both sides of the access road, and shall maintain such fences in good order and repair.

(2.) The Public Works Department or any other Government Department shall have the right to take metal from the pit for Government works at any time without payment of royalty.

(3.) The said Council shall work the pit to the satisfaction of the Public Works Engineer for the district, and such working of the pit shall be under the supervision of the said Engineer, who shall have the right to direct from what particular part or parts of the pit the metal may be taken by the Council or contractors for work let by the Council.

(4.) In the event of the said Council or contractors for work let by the Council desiring to work the pit at the same time as the Public Works Department or other Government Department, or contractors for work let by such Department, the Department and its contractors shall have preference.
