SCHEDULE.
ALL the milling-timber on that parcel of land, containing approximately 150 acres, situated in Provisional State Forest No. 99, Block IX, Puketapu Survey District.
The estimated quantity of milling-timber in superficial feet is 2,948,103, being totara 1,274,748, rimu 819,021, miro 49,274, matai 786,448, and kahikatea 18,612.
Upset price, £6,784.
Term, four years from date of sale.
Terms of Payment.—One-eighth of the purchase-money, together with £1 1s. license fee, must accompany the tender, and the balance be paid as follows: One-eighth in three months, one-eighth in six months, one-eighth in nine months, and the remainder in twelve equal quarterly instalments. In addition, the purchaser will require to pay a ground rent of 1s. per acre half-yearly in advance.
All instalment-payments shall be secured by “On demand” promissory notes made and endorsed to the satisfaction of the Conservator of Forests, and interest at the rate of 5 per cent. per annum will be charged on all notes overdue from the date of maturity to the date of payment.
CONDITIONS OF SALE.

The right to cut and remove the timber will be sold in accordance with the terms of the Forests Act, 1921–22, the regulations in force thereunder, and the following conditions.

Intending tenderers are expected to visit the locality and to satisfy themselves in every particular on all matters relative to the sale.

The aforementioned quantities, qualities, and kinds as to the said timber shall be taken as sufficiently accurate for the purposes of this sale, and no contract for the purchase shall be voidable, nor shall the successful purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, or kind than as stated herein or in any advertisement having reference to the said timber.

The promissory notes will be presented at intervals as indicated in the terms of payment, but they may be presented for payment at an earlier date if it is found that more than a due proportion of the timber has been cut, or should any breach of the conditions occur, or if in the opinion of the Conservator the interests of the Crown are being jeopardized.

Each tenderer must state the total price that he is prepared to pay for each species. The highest or any tender will not necessarily be accepted, and the timber described is submitted for sale subject to the final acceptance of the tender by the Commissioner of State Forests.

A return, verified by affidavit, giving the number of logs cut of each species and their contents, must be made quarterly by the licensee each quarter ending on the last day of June, September, December, and March respectively in each year. A return, similarly verified, must be made quarterly on the same dates showing the output of sawn timber of each species.

All timber must be cut to the best advantage, and cutting operations must be carried on regularly and generally in a manner approved of by the Conservator of State Forests.

The settlement of any disputes shall be effected by the Conservator of State Forests, and there will be a right of appeal to the Commissioner of State Forests, whose decision in all cases shall be final. Should the licensee fail to fulfil any and every obligation incumbent upon him the license will be subject to cancellation.

The Commissioner of State Forests may authorize the laying-down and working of tram-lines through the land by other persons than the licensees.

The successful tenderers will be granted licenses to cut the timber, the periods for which will be as above stated, and will not be extended. The license will not be transferable, except with the consent of the Commissioner of State Forests. Cutting operations must commence within six months of the date of the license.

The right is reserved to the Commissioner of State Forests to withdraw from sale any or all of the said timber either before or after the closing-date for receipt of tenders.

If no tenders are accepted for any of the lots herein mentioned, it will remain open for application at the upset price until further notice.

The successful tenderers shall only be permitted to cut timber on private lands and Warden’s licenses simultaneously with the lots mentioned herein by obtaining permission from the Conservator of Forests.

The licensee shall take all reasonable precautions by way of providing such safeguards as may be required by the Conservator for the prevention of damage to the adjacent bush by fires caused by sparks from locomotives, log-haulers, or otherwise, and shall be liable for any damage thereto in consequence of any negligence or disregard of these conditions on the part of the licensee or his workmen, such damage to be assessed by the Conservator of State Forests, whose decision shall be final.

Tenders should be addressed “Conservator of State Forests, Auckland,” and envelopes endorsed “Tender for Timber.”

Land in Makowai Settlement, Wellington Land District, open for Selection on Renewable Lease.

NOTICE is hereby given that the undermentioned land is open for selection on renewable lease under the provisions of the Land Act, 1908, and the Land for Settlements Act, 1908, and amendments; and applications will be received at this office up to 4 o’clock p.m. on Monday, the 26th June, 1922.
Applicants should appear personally before the Land Board for Examination at this office at 10 o’clock a.m. on Tuesday, the 27th June, 1922.
The ballot will be held on Tuesday, the 27th June, 1922, at the conclusion of examination of applicants.
Preference at the ballot will be given to landless applicants who have one or more children dependent on them; to landless applicants who within two years immediately preceding date of ballot have applied for land at least twice unsuccessfully; to applicants who have served beyond New Zealand as members of the Expeditionary Force; and to persons engaged on military service beyond New Zealand in connection with the late war, if such persons immediately prior to the war were bona fide residents of New Zealand.

WELLINGTON LAND DISTRICT.—SETTLEMENT LAND.—FIRST-CLASS LAND.
Manawatu County.—Te Kawau Survey District.—Makowai Settlement.
SECTION 11 and part Section 6: Area, 81 acres 3 roods 16 perches; capital value, £3,795; deferred-payment instalment (including interest), £211*; half-yearly rent on lease, £85 7s. 9d.; interest and sinking fund, £16 11s. 6d.†
- The deferred-payment instalment includes payment for buildings.
† Interest and sinking fund on buildings valued at £425, to be paid for in cash, or in twenty-one years by half-yearly instalments of £16 11s. 6d. Total half-yearly payment on lease, £101 19s. 3d.
The section is fourteen miles from Feilding via Awahuri Road, and fourteen miles from Foxton by Foxton-Sandon tramway. Mostly flat land, suitable for cropping or dairying; well watered; all in grass. There is a dwelling of six rooms, cow-shed, shed and washhouse, on the section.
The improvements, valued at £310 15s. 9d., included in the capital value consist of 112 chains fencing, 4 chains metalled road, windmill, bridge, trough, and water-dam.
ABSTRACT OF CONDITIONS OF LEASE.

Term of lease, thirty-three years, with a perpetual right of renewal for further successive terms of thirty-three years and a right to acquire the freehold.

Rent, 4½ per cent. per annum on the capital value, payable in advance on 1st January and 1st July in each year.

Applicants to be twenty-one years of age and upwards.

Applicants to furnish with applications statutory declaration, and, on being declared successful, deposit £1 1s. (lease fee) and a half-year’s rent. Rent for the broken period between date of lease and 1st January or 1st July following is also payable.

Applications made on the same day are deemed to be simultaneous.
