of the Supreme Court, to be appointed to that Division by

the Governor-General in Council:
And whereas the power conferred by the said Act upon
the Governor-General in Council of appointing Judges as
members of either Division, or of revoking any such appointment, shall be exercisable on the recommendation of not less
than three Judges of the Supreme Court (of whom the Chief
Justice shall be one), and not otherwise:
And whereas the Right Honourable the Chief Justice, the
Honourable Mr. Justice Hosking, and the Honourable Mr.
Justice Reed have recommended that the two Divisions of
the Court of Appeal shall be constituted as shown hereafter:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in exercise of the powers
conferred by the said Act, and acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby appoint

Defining the Limits of the Port or Harbour of Hicks Bay.

ORDER IN COUNCIL.
At the Government House at Wellington, this 23rd day of
February, 1922.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twelfth day of
September, one thousand nine hundred and twenty-one, and published in the New Zealand Gazette No. 87, of the
twenty-second day of the same month, it was declared that
the Matakaoa County Council should exercise the powers of
a Harbour Board, and the limits of the port or harbour of
Hicks Bay were defined:
And whereas it is desirable to amend such Order in Council
in the manner hereinafter described:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by section six
of the Harbours Act, 1908, and acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby revoke the last paragraph of the hereinbefore-recited Order in Council, and doth hereby in lieu thereof
define the limits of the port or harbour within which the
Council of the County of Matakaoa is to exercise its powers
of a Harbour Board to be as follows, that is to say:-
All that area covered by the sea at high-water mark ordinary spring tides, lying inside a straight line from Matakaoa
Point to Tarakeha Point; as the said area is shown coloured
red on plan marked M.D. 5426, and deposited in the office
of the Marine Department at Wellington.

Declaring Portion of Road in Block VI, Katikati Survey
District, to be a Government Road.

ORDER IN COUNCIL.
At the Government House at Wellington, this 23rd day of
February, 1922.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
In pursuance and exercise of the powers vested in him
by the Public Works Act, 1908, and of all other powers
in anyway enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council of
the said Dominion, doth hereby order and declare that the
portion of road described in the Schedule hereto shall, on
and after the date of this Order in Council, become a Government road.
SCHEDULE.
APPROXIMATE area of the piece of road declared to be a
Government road: 19 acres 2 roods.
Being portion of road adjoining Te Kauri Village, situated
in Block VI, Katikati Survey District, Tahawai Parish
(Auckland R.D.). (S.O. 21736.)
In the Auckland Land District; as the same is more
particularly delineated on the plan marked P.W.D. 53482,
deposited in the office of the Minister of Public Works at
Wellington, in the Wellington Land District, and thereon
coloured green.

Declaring Portion of the Tumu Tumu Road, in the Waitomo
County, to be a County Road.

road.
SCHEDULE.
ALL that portion of the Tumu Tumu Road, in the Auckland
Land District, Waitomo County, commencing at its junction
with the Waitomo Caves Road, at a point about five chains
east of the Okohua Stream crossing in part Section 6,
Block X, Orahiri Survey District, and proceeding thence
generally in a south-westerly direction, adjoining or passing
through part Section 6, Hauturu East 1E 5c 2E, Block X,
Hauturu East 1E 5c 2d 3, Blocks X and XIV, Sections 6
(school reserve), 4A, 5 (school-site), and 1, Block XIV, Orahiri
Survey District, and terminating at the south-western corner
of the said Section 1, Block XIV, Orahiri Survey District;
being a distance of 2 miles 65 chains, more or less. As the
said portion of road is more particularly delineated on the
plan marked P.W.D. 53748, deposited in the office of the
Minister of Public Works at Wellington, in the Wellington
Land District, and thereon coloured red.

No. 2, Blocks X and XI, Totoro Survey District, and terminating at its junction with the Oniao Road, in the said
Block XI, Totoro Survey District; being a distance of four
miles, more or less. As the said portion of road is more
