Home for Fallen Women.

In the Supreme Court of New Zealand,
Wellington District.

In the matter of the Religious, Charitable, and Educational Trusts Act, 1908. And in the matter of the trusts of a certain deed of conveyance dated the 25th August, 1885, made between Edward Pearce, of Wellington, Merchant, and Charles Johnson Pharazyn, of the same place, Esq., of the first part; John McNamara, of the said City of Wellington, Boardinghouse-keeper, of the second part; and William Hort Levin, Merchant, John Rutherford Blair, Bookseller, John Guthrie Wood Aitken, Merchant, James McAlpine, Painter, and William Price, Insurance Agent, all of the said City of Wellington, of the third part.

Between the Public Trustee of the Dominion of New Zealand, as trustee of the above-mentioned trusts, Plaintiff;

And His Majesty’s Attorney-General for the Dominion of New Zealand, of Wellington, the Commissioner of the Salvation Army, of Wellington, and the Wellington Ladies Christian Association, a separate institution under the Hospitals and Charitable Institutions Act, 1909, of Wellington, Defendants.

WHEREAS in and by a deed of conveyance bearing date the 25th day of August, 1885, made between Edward Pearce, of the City of Wellington, Merchant, and Charles Johnson Pharazyn, of the same place, Esquire, of the first part; John McNamara, of the said City of Wellington, Boardinghouse-keeper, of the second part; and William Hort Levin, Merchant, John Rutherford Blair, Bookseller, John Guthrie Wood Aitken, Merchant, James McAlpine, Painter, and William Price, Insurance Agent, all of the said City of Wellington, of the third part; and registered in the Deeds Registry Office at Wellington under Number 49989, certain lands therein mentioned and described were thereby conveyed and assured to the before-mentioned parties of the third part (therein called “the trustees”) upon trust for the establishment and maintenance of a house, home, or refuge to be called “The Wellington Christian Society’s Home for Fallen Women,” and upon further trust to raise from time to time upon mortgage of the said pieces of land or any part thereof a sum not exceeding four hundred and fifty pounds (£450) for such purpose, for such period, and on such terms and conditions as the said trustees might deem fit, and upon such further or other trusts as should thereafter be declared by the trustees concerning the said pieces or parcels of land, with power for the trustees to make and ordain such rules and regulations for the proper and efficient management and conduct of the said house, home, or refuge or in relation thereto, and from time to time to alter, vary, or abolish any of such rules or regulations as the said trustees should think fit:

And whereas by an order of the Supreme Court of New Zealand made at Wellington on a petition in the matter of the said trusts on the 17th day of May, 1907, the then trustees were directed to sell the said lands and out of the proceeds of sale to pay off the existing encumbrances thereon and all incidental costs, and to pay the balance together with any other moneys in their hands belonging to the said trusts into the hands of the Public Trustee to be held by him upon trust to invest the same and the accumulations thereof until the same with such accumulations should form a fund sufficient in his opinion to enable him actively to carry out the trusts expressed in the aforesaid deed of conveyance registered number 49989, and upon further trust from that time for the Public Trustee actively to carry out the said trusts:

And whereas in and by the said order of Court the Public Trustee was appointed trustee under the said trusts in the place and stead of the then existing trustees:

And whereas the net proceeds of sale of the said lands were duly paid into the Public Trust Office and now amount to the sum of approximately £1,900:

And whereas by reason of the inadequacy of the said sum it is impracticable to carry out the said trusts on which the said moneys are now held, and it is desirable that such moneys should be disposed of for some other analagous charitable purpose:

Now, this is to notify all whomsoever it may concern that on Thursday, the 25th day of August, 1921, the Public Trustee caused to be filed in the office of the Supreme Court at Wellington a scheme providing for the distribution of the said trust moneys in manner following:—

  1. The Public Trustee shall divide the trust funds now held by him into two equal portions, and hold one of such portions upon the following trusts, namely,—

(a.) Upon trust to pay the same to the trustees of the Wellington Ladies Christian Association, to be applied by such body in and towards defraying the cost of erecting, equipping, furnishing, maintaining, and repairing an addition or wing to the Alexandra Home for Women on the site now leased to it from the Crown under deed of lease dated the 22nd day of February, 1916.

(b.) The said addition or wing shall be appropriated and used for the confinement of poor and destitute unmarried women during their confinement.

(c.) The said wing shall be governed, controlled, and administered by the Wellington Ladies Christian Association for poor and destitute women during confinement in the same manner as the said association generally controls and administers the Alexandra Home for women, and shall be subject to the same statutory provisions affecting the said home.

  1. The Public Trustee shall hold the remaining one of such portions of the said trust property upon trust to pay the same to the New Zealand Branch of the Salvation Army, to be applied by such body in and towards the cost of maintaining and carrying on the institutions known as the Salvation Army “Paulina” Rescue Home, Owen Street, Wellington South, and the Maternity Hospital for single girls in Kensington Street, Wellington.

The application to the Supreme Court to approve the foregoing scheme is set down for hearing at the Supreme Court, Wellington, on Wednesday, the 2nd day of November, 1921.
