Rules under Crimes Act, 1908, regulating Procedure on Appeals
from Sentences.

———

WE, the undersigned Judges of the Supreme Court of
New Zealand (of whom the Acting Chief Justice is
one), in pursuance of the powers conferred upon us by section
354 of the Crimes Act, 1908, do hereby make the following
rules regulating the practice and procedure in connection
with appeals under section 2 of the Crimes Amendment Act,
1920:—

  1. (a.) Every application for leave to appeal against a
    sentence shall be signed by the appellant, and shall be in the
    form set forth in the Schedule hereunder.

(b.) The Court of Appeal in special circumstances may
accept such application if signed on behalf of the appellant
by his solicitor.

(c.) Every such application shall be delivered to or trans-
mitted by post to the Registrar of the Court of Appeal.

  1. Notice of every such application shall be given by the
    Registrar of the Court of Appeal to the Solicitor-General, who
    shall be entitled to appear and represent the Crown on the
    hearing of such application and on the hearing of the appeal
    (if leave to appeal is granted); but the Solicitor-General,
    instead of appearing himself, may authorize a private prose-
    cutor to appear and represent the Crown on any such hearing.

  2. Where the Court of Appeal has given leave to appeal it
    shall not be necessary for the appellant to give any notice of
    appeal, but his application for leave to appeal shall be
    deemed in such case to be a notice of appeal.

  3. The appellant, if in custody, shall not be entitled to be
    present at the hearing of the application for leave to appeal
    or on the hearing of the appeal, unless the Court of Appeal
    shall grant permission to him to be present at such hearing.

  4. The Court of Appeal may order any witnesses to attend
    and be examined before the Court on the hearing of an
    application for leave to appeal or on the hearing of an
    appeal, but the appellant shall not be entitled to call any
    witnesses on such hearing without having first obtained the
    leave of the Court of Appeal to do so.

  5. The decision of the Court shall be pronounced by the
    presiding Judge, or such other member of the Court as the
    Court directs, and no separate judgment shall be pronounced
    by any other member of the Court.

  6. Where the Court of Appeal has heard and dealt with any
    application or appeal the Registrar shall give notice to the
    appellant of the decision of the Court of Appeal in relation
    thereto.
