Validating Proceedings in connection with the Raising of a Loan of £60,000 by the Council of the Borough of New Plymouth.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of July, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the New Plymouth Borough Council lately proposed to raise a loan of sixty thousand pounds, under the provisions of the Local Bodies’ Loans Act, 1913, for the purpose of providing additions and extensions to the Council’s electric lighting and power works:

And whereas section nine of the said Act provides that a notice setting forth the proposal to raise the loan shall be published once in each week for four successive weeks:

And whereas the notice setting forth the proposal to raise the loan was not published once in each week for four successive weeks, inasmuch that the said notices were published in the Taranaki Herald on the third and eighth, fifteenth and twenty-second days of November, one thousand nine hundred and twenty:

And whereas it appears that the ratepayers have not been misled by such irregularity or defect, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though the notice of proposal to raise the loan had been published in the manner prescribed in section nine aforesaid, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularity aforesaid.

Lands temporarily reserved in the North Auckland, Auckland, and Southland Land Districts.

JELLICOE, Governor-General.

WHEREAS by the three-hundred-and-twenty-first section of the Land Act, 1908, it is enacted that the Governor-General may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

Now, therefore, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby temporarily reserve from sale the lands in the North Auckland, Auckland, and Southland Land Districts described in the Schedule hereunder written, for the purposes in the said Schedule specified at the end of the respective descriptions of the lands so intended to be temporarily reserved.


SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the North Auckland Land District, containing by admeasurement 1 rood 10 perches, more or less, being part of Allotment 1 of Section 3, City of Auckland, and bounded as follows: Commencing at the eastern corner of Lot 1 of Allotment 1 of Section 3, City of Auckland, bounded towards the north generally by Fort Street to the northernmost corner of Allotment 2 of Section 3 aforesaid; thence towards the east generally by the said Allotment 2 to Shortland Street; thence towards the south generally by Shortland Street to the southernmost corner of Lot 9 of Allotment 1 of Section 3 aforesaid; thence towards the west generally by the said Lot 9 and Lot 1 before mentioned to the point of commencement. As the same is delineated on the plan marked L. and S. 6/3/183, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (Auckland plan No. 661A.) For a site for public buildings of the General Government.

AUCKLAND LAND DISTRICT.

All that area in the Auckland Land District, containing by admeasurement 2 roods 11·2 perches, more or less, being part of Sections 192, 193, 194, 195, and 196, Town of Ngaruawahia. Bounded towards the north-east by the North Island Main Trunk Railway, 690·05 links; towards the south-east by Struve Street, 251·4 links; and towards the south-west by the South Road, 453·6 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 6/11/20, deposited in the Head Office, Department of Lands and Survey, Wellington, and thereon bordered red. (Auckland plan No. 5784, blue.) For defence purposes.

Also all that area in the Auckland Land District, containing by admeasurement 1 acre, more or less, being part of Section 5, Block X, Whaingaroa Survey District. Bounded towards the north-east by other part of Section 5, Block X, Whaingaroa Survey District, 199·9 links; towards the south-east by a public road, 500·2 links; towards the south-west by other part of the said Section 5, 199·9 links; and towards the north-west by other part of the said Section 5, 500·2 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 6/6/304, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (Auckland plan No. 20854, blue.) For a public-school site.

SOUTHLAND LAND DISTRICT.

All those areas in the Southland Land District, containing by admeasurement 30 acres 2 roods 33·81 perches, more or less, situated in Blocks XIII and XIV, Taringatura Survey District, as described in Proclamation dated the 21st day of January, 1921, published in the New Zealand Gazette No. 7, 1921, page 190. As the same are more particularly delineated on the plan marked L. and S. 16/783, deposited in the Head Office, Lands and Survey Department, Wellington, and thereon coloured green. For a primary education endowment.

Opening Land in Hawke’s Bay Land District for Sale or Selection.

JELLICOE, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon me by the Land Act, 1908, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, having received the report of the Under-Secretary in this behalf, as provided by section one hundred and fifty-four of the said Act, do hereby declare that the land described in the Schedule hereto shall be open for sale or selection on Tuesday, the sixth day of September, one thousand nine hundred and twenty-one; and also that the land mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase, or on renewable lease; and I do hereby also fix the price at which the said land shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said land shall be sold, occupied, or leased under and subject to the provisions of the Land Act, 1908.


SCHEDULE.

HAWKE’S BAY LAND DISTRICT.—THIRD-CLASS LAND.

Wairoa County.—Tuahu Survey District.

SECTION 2, Block XIII: Area, 3,732 acres 1 rood 8 perches; capital value, £4,665; half-yearly rent, £93 6s.

Altitude from 1,800 ft. to 3,600 ft. above sea-level. The country towards the back is steep and broken, but easier towards the road. All in mixed bush, chiefly birch, with some totara, miro, and hinau throughout. Some undergrowth of supplejack, horopito, karamu, and mahoe in the gullies. Well watered by permanent streams. About thirty-five miles from the port of Wairoa.

IN pursuance and exercise of the powers and authorities conferred upon me by the Land Act, 1908, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, do hereby declare that the national-endowment land described in the Schedule hereto shall be open for selection on renewable lease on Tuesday, the sixth day of September, one thousand nine hundred and twenty-one,
