Amending Scale of Dues for Use of Waitapu Wharf.

ORDER IN COUNCIL.
At the Government House at Wellington, this lst day of March, 1921.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the nineteenth day of May, one thousand nine hundred and thirteen,
and published in the New Zealand Gazette No. 43, of the twenty-ninth day of the same month, dues and rates were prescribed for the use of the wharf at Waitapu vested in the Takaka County Council:
And whereas by Order in Council dated the twenty-eighth day of May, one thousand nine hundred and seventeen,
and published in the New Zealand Gazette No. 91, of the thirty-first day of the same month, the said dues and rates were amended :
And whereas it is desired to revoke the said dues and rates and to prescribe others in lieu thereof :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section thirteen of the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the dues and rates prescribed in the Schedule to the hereinbefore-recited Order in Council of the twenty-eighth day of May, one thousand nine hundred and seventeen; and doth hereby prescribe that the dues and rates set forth in the Schedule hereto shall, on and after the date of this Order in Council, be taken and charged by the Takaka County Council for the use of the said wharf.

Licensing Thomas Charles Hawkins to use and occupy a Part of the Foreshore and Land below Low-water Mark at Tangowahine, in Kaipara Harbour, as a Site for a Wharf and Log-slip.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the sixth day of December, one thousand nine hundred and fifteen,
and published in the New Zealand Gazette No. 141, of the ninth day of the same month, Messrs. R. P. Gibbons (Limited) was licensed under the Harbours Act, 1908, to occupy a part of the foreshore and land below low-water mark at Tangowahine, in Kaipara Harbour, in order to erect thereon a wharf and log-slip, as shown on the plans marked M.D. 2495 and 2915 deposited in the office of the Marine Department at Wellington :
And whereas the said license was, with the consent of the Minister of Marine, transferred to Thomas Charles Hawkins (hereinafter called “the licensee”):
And whereas the licensee has made application for a fresh license under the Harbours Act, 1908 (hereinafter called “the said Act”), for a further term of ten years, computed from the twenty-third day of September, one thousand nine hundred and twenty, and it is expedient to grant the same for the term and subject to the conditions hereinafter expressed :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensee as aforesaid ; and, in further pursuance and exercise of the said power and authority, and by and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore and land below low-water mark which is particularly shown and delineated on the plans so deposited as aforesaid, for the purpose of maintaining the aforesaid wharf and log-slip thereon, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

  1. In these conditions the term “Minister” means the Minister of Marine as defined by the Shipping and Seamen
