Validating Proceedings relative to Proposed Inclusion of Point Chevalier Road District in the City of Auckland.

ORDER IN COUNCIL.
At the Government House at Wellington, this 1st day of March, 1921.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS a petition was presented, under section fourteen of the Municipal Corporations Act, 1908, praying for the inclusion of the Point Chevalier Road District in the City of Auckland :
And whereas objections to the proposal were received, and a Commission to consider the same was duly appointed, and recommended that such road district be included in such city :
And whereas a poll of electors was taken under the provisions of the Municipal Corporations Amendment Act, 1914, such poll being duly carried :
And whereas it is proposed to include the said Point Chevalier Road District in the said City of Auckland :
And whereas doubts have arisen as to the validity of the above proceedings on the ground that they should have been taken according to the form prescribed by section one hundred and twenty of the Municipal Corporations Act, 1908, and not as above set out :
And whereas it is considered expedient to validate the aforesaid proceedings, so as to render them in all respects as valid and effectual for the purposes of constituting one united borough as if they had been taken according to the form prescribed by section one hundred and twenty of the Municipal Corporations Act, 1908 :
Now, therefore, I, John Rushworth, Viscount Jellicoe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section three hundred and sixty-eight of the said Act, and of every other power and authority enabling me in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby validate all proceedings taken relative to the inclusion of the Point Chevalier Road District in the City of Auckland accordingly.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS a petition has been presented to the Governor-General, under section fourteen of the Municipal Corporations Amendment Act, 1913, praying the Governor-General to alter the boundaries of the City of Auckland by including therein the area described in the Schedule hereto, comprising the Point Chevalier Road District :
And whereas a notice, showing the proposed alteration in boundaries of the said city, has been gazetted and publicly notified :
And whereas objections in writing against such alteration were lodged :
And whereas, after inquiry and report by a Commission appointed under the said section, a poll was taken under the provisions of the Municipal Corporations Amendment Act, 1914, on the eighteenth day of December, one thousand nine hundred and twenty, on the proposal to include the said area in the City of Auckland, and the result of that poll was in favour of the said proposal :
