Government Orders and Appointments




  1. Save in pursuance of a permit issued by the Wheat
    Controller appointed under the Wheat Trade Regulations,
    1920, made on the 16th day of March, 1920, it shall not be
    lawful for any person in New Zealand, at any time while
    this Order in Council remains in force, to purchase or agree
    or offer to purchase, whether as principal, agent, or otherwise,
    any wheat of the harvest of the season 1920-21 in New Zealand,
    or to be concerned in New Zealand in the making of
    any such purchase, agreement, or offer by any other person,
    whether in New Zealand or elsewhere, or to be concerned in
    New Zealand in the fulfilment or performance of any agreement
    for the purchase of any such wheat, whether such
    agreement has been made in New Zealand or elsewhere, and
    whether it has been made before or after the making of these
    regulations.

  2. In these regulations the term “purchase” includes any
    mode of acquisition by agreement, save that acquisition by
    way of security only shall not be deemed to be a purchase.

  3. For the purpose of these regulations an option or right
    of purchase shall be deemed to be an agreement to purchase.

  4. For the purpose of these regulations every agreement
    for the purchase of wheat shall be deemed to be an agreement
    for the purchase of wheat of the harvest of the season 1920-21
    in New Zealand if in accordance with the terms thereof any
    wheat of that description could be delivered in due fulfilment
    of the agreement. The provisions of these regulations as
    to offers, options, or right of purchase shall be construed in
    like manner.

  5. In granting a permit under these regulations the Wheat
    Controller may impose such terms and conditions as to the
    purchase and as to the disposition or use of the wheat so
    purchased as the Controller thinks advisable for the due
    regulation and maintenance of industries essential for the
    public welfare.

  6. Any such permit may be granted or refused in the
    absolute discretion of the Wheat Controller, and shall be
    revocable at the will of the Controller.

  7. When any wheat has been purchased under any such
    permit, it shall not be lawful for the purchaser to deal with
    it otherwise than in accordance with the terms and conditions
    on which the permit was granted.

  8. The Wheat Controller, or his duly authorized representative,
    may require any person to give to him information
    relative to the sale or purchase of any wheat, whether by the
    person so required to give information or by any other person,
    and it shall be the duty of such persons, when so required,
    to give all such information in their possession accordingly.

  9. Any person who makes any false representations with
    intent thereby to obtain any permit under these regulations
    either for himself or for any other person, or who in any
    manner deceives or attempts to deceive the Wheat Controller
    in the exercise of the powers conferred by these regulations,
    shall be guilty of an offence against these regulations,
    and shall be liable accordingly.

Recreation Reserve in Wellington Land District brought under
Part II of the Public Reserves and Domains Act, 1908.

ORDER IN COUNCIL.
At the Government House at Auckland, this 26th day of
January, 1921.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
BY virtue of the powers and authorities vested in me by
the twenty-sixth section of the Public Reserves and
Domains Act, 1908, I, John Rushworth, Viscount Jellicoe,
Governor-General of the Dominion of New Zealand, by and
with the advice and consent of the Executive Council of the
said Dominion, do hereby order and declare that the reserve
for recreation in the Wellington Land District described
in the Schedule hereto shall be and the same is hereby
brought under the operation of and declared to be subject
to the provisions of Part II of the said Act; and such reserve
shall hereafter form part of the Gonville Domain, and be
managed, administered, and dealt with as a public domain
by the Gonville Town Board.

SCHEDULE.
ALL that area in the Wellington Land District, containing
by admeasurement 38 acres 3 roods 31·6 perches, being
part Section 7 and part Section 8, Right Bank Wanganui
River, as shown on deposited plan 3982 and in certificate of
title, Vol. 270, folio 31.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 1st day
of February, 1921.

IN COUNCIL.
IN pursuance and exercise of the powers conferred by
the Public Works Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Waimairi County Council on the
tenth day of January, one thousand nine hundred and
twenty-one—viz., “The Waimairi County Council, being a
local authority having control of Queen’s Avenue, situated
between Wairarapa Terrace and Holmwood Road, as shown
coloured red on the accompanying tracing, by resolution
declares that the provisions of section one hundred and
seventeen of the Public Works Act, 1908, shall not apply to
the said road”; such road being described in the Schedule
hereto.

SCHEDULE.
ALL that road, situated in the Canterbury Land District,
Waimairi County, known as Queen’s Avenue, situated between
Wairarapa Terrace and Holmwood Road. As the said
road is more particularly delineated on the plan marked
P.W.D. 50409, deposited in the office of the Minister of Public
Works at Wellington, in the Wellington Land District, and
thereon coloured red.

Taieri River Trust.—Appointment of Returning Officer, and
Arrangements for First Election of Trustees.

JELLICOE, Governor-General.
IN pursuance and exercise of the powers and authorities
conferred on me by the River Boards Act, 1908, and by
the Taieri River Improvement Act, 1920, I, John Rushworth,
Viscount Jellicoe, Governor-General of the Dominion of New
Zealand, do hereby appoint William Ernest McLean, Esquire,
of Mosgiel, to be Returning Officer to hold the first election
of one member to represent each of the West Taieri, Momona,
Snow, Lee Creek, and Lakes Subdivisions of the Taieri River
Trust District as constituted by the Taieri River Improvement
Act, 1920. And do also appoint Tuesday, the first day
of March, one thousand nine hundred and twenty-one, as the
day, and the Oddfellows’ Hall, Outram ; Public Hall, Momona ;
County Hut, Otokia ; and Public Halls at Henley and Berwick,
as the places for such elections. And I do also appoint
Tuesday, the eighth day of March, one thousand nine hundred
and twenty-one, at eleven o’clock in the forenoon, to be the
day and hour, and the office of the Western Taieri Land Drainage
Board, Coronation Hall, Mosgiel, to be the place,
at which the first meeting of the Taieri River Trust shall be
held.

As witness the hand of His Excellency the Governor-General, this 7th day of February, 1921.
