(4.) Become bankrupt, or be in any manner brought under the operation of any law in force for the time being relating to bankruptcy,—
then and in any of the said cases this Order in Council, and every right, power, and privilege may be revoked and determined by the Governor-General in Council, without any notice to the licensee or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the licensee, and to all persons concerned or interested, that this Order in Council, and the rights and privileges thereby conferred, have been revoked and determined; and upon such revocation the Minister may cause the said jetty to be removed, and may recover the costs incurred by any such removal from the licensee.

  1. The construction of the jetty shall be deemed to be an acceptance by the licensee of the conditions of this Order in Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1921.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council dated the eighteenth day of June, one thousand nine hundred and eighteen, and published in the New Zealand Gazette No. 93, of the twenty-seventh day of the same month, the Waitemata Sawmill Company (Limited), of Auckland (hereinafter called “the company”), was licensed to use and occupy a portion of the foreshore and land below low-water mark of the Waikare River and Waikiwi Creek, Bay of Islands, as sites for timber-booms, as shown on plan marked M.D. 4934, and deposited in the office of the Marine Department at Wellington:

And whereas the company has made application to have the said license revoked, and it is desirable to revoke the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council dated the eighteenth day of June, one thousand nine hundred and eighteen, and the rights and privileges thereby conferred.

NOTICE.—ARTHUR HEREWARD NEVETT, Esq., of Ballarat, in the State of Victoria, a Solicitor of the Supreme Court of Victoria, has this day been appointed by the Honourable John Henry Hosking, Esq., a Judge of the Supreme Court of New Zealand, a Commissioner of the Supreme Court of New Zealand in the State of Victoria under the 47th section of the Judicature Act, 1908, for the purpose of administering and taking all such oaths, affidavits, and affirmations as in the said section mentioned.
