REGULATION.

47A. (1.) EVERY application to the Minister under section 15, subsection (1), of the Coal-mines Act, 1908, for any right in respect of the timber, trees, metals, or minerals excepted out of any coal lease by subsection (1) (c) and (d) of section 15 may be made to the Warden nearest to the place where the lands are situated, in the manner prescribed by section 8, the provisions of which shall, mutatis mutandis, apply.

(2.) The Warden shall hear such application and any objections thereto, and shall forward the application to the Minister, together with a copy of the evidence taken at the hearing and with his recommendation thereon; and the Minister may, in his discretion, grant or refuse the right applied for on such terms and conditions as he thinks fit.

Approving the Term of the License granted to William Lorigan by the Stratford County Council for a Tramway along Wawiri Road, Taranaki.

At the Government House at Wellington, this 11th day of October, 1920.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred on him by the Tramways Act, 1908, and the Tramways Amendment Act, 1910, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the term of the license granted for a period of ten years from the sixteenth day of April, one thousand nine hundred and eighteen, by the Stratford County Council to William Lorigan, of Te Kuiti, Settler, authorizing the said William Lorigan to construct and maintain a private tramway along Wawiri Road commencing at a point opposite the north-western corner of Section 1, Block XVI, Huiroa Survey District, and terminating at the junction of Wawiri Road with Ahuroa Road opposite Section 4, Block IV, Ngaiere Survey District, as shown coloured red on the plan marked P.W.D. 49537, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District.

Authorizing the Minister of Public Works to erect, construct, provide, and use certain Works, Appliances, and Conveniences in connection with the Utilization of Water-power from the Waikare-Taheke River, situated in the Land District of Hawke’s Bay, for the Generation, Storage, Transmission, Distribution, and Sale of Electrical Energy, in terms of Section 272 of the Public Works Act, 1908.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by section two hundred and seventy-two of the Public Works Act, 1908, as amended by section six of the Public Works Amendment Act, 1910, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Minister of Public Works to erect, construct, provide, and use such works, appliances, and conveniences as may be necessary in connection with the utilization of water-power from the Waikare-Taheke River for the generation and storage of electrical energy, and with the transmission, use, supply, and sale of electrical energy when so generated; also to use electrical energy so generated in the construction, working, or maintenance of any public work, or for the smelting, reduction, manufacture, or development of ores, metals, or other substances; also to raise or lower the level of the said river, and impound or divert the waters thereof into the Kaitawa Lake, and return the water to the said river; also to construct tunnels under private land, or aqueducts and flumes over the same, erect poles thereon, and carry wires over or along any such land without being bound to acquire the same, and with right of way to and along all such works and erections; and also to supply and sell electrical energy, and recover moneys due for the same.

  • Cancelling a Condition as to setting back the Building-line of Thompson Street in the City of Wellington, imposed by an Order in Council under Section 117 of the Public Works Act, 1905.*

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of October, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Amendment Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the fifteenth day of July, one thousand nine hundred and seven, and published in Gazette No. 63, page 2138, of the eighteenth day of the same month, exempting Thompson Street in the City of Wellington from the provisions of section one hundred and seventeen of the Public Works Act, 1905, subject to a condition as to the building-line, by cancelling the condition as to setting back the building-line for a distance of thirty-three feet from the centre of the said street.

Cast-iron Chocks and Bored Iron Bars, being Rail-fastenings.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of October, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by section one hundred and thirty-five of the Customs Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that cast-iron chocks and bored iron bars, being rail-fastenings, which are not enumerated in the Tariff, and which are, in the opinion of the Minister of Customs, substitutes for fish-plates, shall be admitted into the said Dominion free of duty if the produce or manufacture of some part of the British dominions, and shall be liable to duty at the rate of twenty per centum ad valorem if not the produce or manufacture of such dominions; provided that the said cast-iron chocks and bored iron bars, whether the produce or manufacture of the British dominions or not, shall, in addition to the duty (if any) otherwise chargeable, be liable to the primage duty of one per centum ad valorem imposed by section twenty-five of the Finance Act, 1915.

Consenting to the Raising of Loans by certain Local Authorities.

ORDER IN COUNCIL.

At the Government House at Wellington, this 6th day of October, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS application has been made under section twenty, subsection one, of the Finance Act, 1919, for the precedent consent of the Governor-General in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the sums set out therein, and it is expedient that such consent should issue:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the raising of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto, provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-half pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Finance Act, 1919, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the loans hereby authorized.
