Portion of the Southern Side of Elizabeth Street, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this twenty-eighth day of June, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Auckland City Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That the Auckland City Council doth hereby declare that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the portions of Elizabeth Street fronting Lots 1, 2, and 3 of a subdivision of Allotments 96, 97, and parts 98 and 120 of Allotment 20 of Section 8, Suburbs of Auckland”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the southern side of the said portion of street, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the southern side of the said portion of street within a distance of twenty-five feet of the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of Elizabeth Street, in the City of Auckland, adjoining Lots 1, 2, and 3 of subdivision of Lots 96, 97, and parts 98 and 120 of Allotment 20 of Section 8, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 47483, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the eastern side of the said portion of street within a distance of twenty-five feet of the centre-line of the said portion of street.

Salisbury Terrace, in the City of Wellington, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street in the City of Wellington known as Salisbury Terrace, running in a westerly direction from Wright Street and terminating at the Town Belt. As the said street is more particularly delineated on the plan marked P.W.D. 48732, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.
