Constituting the Town District of Cobden in the County of Grey.

A PROCLAMATION.

WHEREAS it is enacted by the Town Boards Act, 1908, that the Governor-General may declare that any locality outside a borough wherein there are not less than fifty householders shall be a town district:

And whereas a petition has been presented to the Governor-General by the inhabitants within the area mentioned and described in the said petition, praying that such area may be constituted a town district under the Town Boards Act, 1908:

And whereas a Commission appointed in pursuance of section two of the Town Boards Amendment Act, 1912, held an inquiry, and reported that the locality defined in the said petition was suitable for municipal control, and made certain alterations of the boundaries thereof:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the Town Boards Act, 1908, and of all other powers enabling me in this behalf, do hereby proclaim and declare that the area described in the Schedule hereto, being the locality defined in the said petition, with boundaries as altered by the said Commission, shall be a town district, and the same is hereby constituted a town district, under the Town Boards Act, 1908, by the name of the Cobden Town District. And, in further pursuance and exercise of the said powers, I do hereby proclaim, declare, and appoint that the Board of Commissioners for the said district shall consist of seven members.

SCHEDULE.

COBDEN TOWN DISTRICT.

ALL that area in the Westland Land District bounded by a line commencing at the north-eastern corner of Section 223, Block IV, Cobden Survey District, and proceeding thence southerly along the western boundary of the Rapahoe Range Scenic Reserve to the south-western corner of Section 1 (part of said reserve); thence along a right line to a point on the northern bank of the Grey River at its intersection with the centre-line of the Cobden Traffic-bridge; thence westerly along a right line to the north-eastern corner of Reserve 1428 (Greymouth Harbour Board endowment reserve), and along the northern boundary of the said reserve to the high-water mark of the Tasman Sea; thence northerly along said high-water mark to a point in line with the northern boundary of Section 223, Block IV, Cobden Survey District, and to and along that boundary to the point of commencement.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Member of His Majesty's Most Honourable Privy Council, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Knight Grand Cross of the Most Excellent Order of the British Empire, Member of the Royal Victorian Order, Knight of Justice of the Order of Saint John of Jerusalem, Governor-General and Commander-in-Chief in and over His Majesty's Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twenty-third day of June, in the year of our Lord one thousand nine hundred and twenty.

Authorizing the Sale of Portion of the Inglewood Town Improvement Endowment, under the Inglewood Borough Endowment Disposal Act, 1915.

A PROCLAMATION.

WHEREAS by section two of the Inglewood Borough Endowment Disposal Act, 1915, it is provided that the Governor-General may by Proclamation authorize the Inglewood Borough Council to sell by public auction, within a period expiring on the first day of July, one thousand nine hundred and twenty, any portion of the Inglewood Town Improvement Endowment not exceeding in the aggregate twenty-six acres, upon such terms and conditions as he may prescribe or approve:

And whereas the lessees for the time being of the lands described in the Schedule hereto have requested the Inglewood Borough Council in writing to offer such lands for sale: And whereas the total area of the said lands authorized to be sold, including the area herein referred to, does not exceed the limit of twenty-six acres hereinbefore mentioned: And whereas it is desirable to authorize the sale of the said lands:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the Inglewood Borough Endowment Disposal Act, 1915, and all other powers and authorities enabling me in that behalf, hereby declare that the lands described in the Schedule hereto may be sold by public auction upon the following terms and conditions:β€”

(1.) Prior to the sale of the said lands due notice of intention to sell shall be advertised in at least two newspapers circulating in the district, and due notice of such sale shall be given for at least fourteen days prior to the date of the sale.

(2.) Each lot will be put up at an upset price which will be named by the auctioneer immediately before the lot is offered, and the bidder of that sum or the highest bidder above that sum shall be the purchaser.

(3.) The upset price of each lot shall be the value of the land plus the value of the improvements on the land, such values to be determined, prior to the sale, by arbitration in the manner prescribed by section nine of the Land Laws Amendment Act, 1912.

(4.) Every purchaser shall pay to the auctioneer immediately after such sale a deposit of one-fifth of the purchase-money of the property purchased by him, and shall, within one calendar month after the date of such sale, complete his purchase, and pay in cash the full purchase-money of the property purchased by him (less such deposit as aforesaid), subject to the provision of clause five hereof.

(5.) In the event of the person requesting any sale becoming the purchaser of the fee-simple of the piece of land being sold at his request, he shall pay to the Council, within one month from the date of such sale, the full purchase price in cash less the deposit payable by him as provided in clause four hereof, and also less the value of improvements on the said land.

(6.) In the event of a sale to a person other than the person requesting such sale, the Council shall immediately upon receipt of the full purchase-money from the purchaser of the property sold pay to the person requesting such sale the value of the improvements on the land.

(7.) The auctioneer's commission and all other charges incidental to a sale or to the offering of the property for sale shall in every case be borne and payable by the person requesting such offer for sale, excepting where such property when offered for sale as aforesaid at public auction is purchased by a person other than the person requesting such sale as aforesaid, in which case the auctioneer's commission and all other charges incidental to such sale (excepting the cost of valuation and advertising) shall be borne by the purchaser of such property, and be paid in cash on completion of the purchase of such property.
