259 kahikatea trees, containing about 336,611 sup. ft. standing measurement; and 19 matai trees, containing about 12,049 sup. ft. standing measurement : total, 348,660 sup. ft.

CONDITIONS OF SALE.
- Intending tenderers are expected to visit the locality and satisfy themselves in every particular on all matters relating to the sale.
- The right is reserved to the Commissioner of Crown Lands to withdraw from sale the above lot of timber.
- The aforementioned quantity, quality, and kind as to the said timber shall be taken as sufficiently accurate for the purpose of this sale, and no contract for purchase shall be voidable, nor shall the purchaser be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if the said quantity of timber is found to be in excess of that stated herein.
- All timber, whether standing, felled, or in logs, shall remain the property of the Crown until paid for.
- The quantity stated is standing measurement, and only those trees bearing the special distinguishing brand are included in the sale, but an offer may be made by the successful tenderer for sixty-six undersized and defective kahikatea trees not included in the sale.
- Should any dispute arise as to the boundaries, the decision of the Commissioner of Crown Lands shall be final.
- In the event of the lot not being disposed of, applications may be received and dealt with at any time within six months from date of sale (unless previously formally withdrawn); provided, however, that the amount offered is not less than the upset price stated herein.
- Tenders must be accompanied by a deposit of 5 per cent. on the amount of tender in cash, marked cheque, or post-office order ; the balance to be paid, if tender accepted, within thirty days of date of accepting of tender.
- The highest or any tender not necessarily accepted.
Tenders to be addressed "Commissioner of Crown Lands," and envelopes to be marked " Tender for Timber."

Timber in Westland Land District for Sale by Public Auction.

Hokitika, 17th December, 1919.
NOTICE is hereby given that the right to cut and remove the timber on the undermentioned land will be offered for sale by public auction at the District Lands and Survey Office, Hokitika, at 2.30 o'clock p.m. on Wednesday, the 25th day of February, 1920, under the provisions of the State Forests Act, 1908, and the Timber Regulations made thereunder.

THE State forest containing 630 acres, situated in Block IX, Kanieri Survey District, and being formerly part of Mining Reserve 1462.
The estimated quantity of timber on the land is—

ABSTRACT OF TERMS AND CONDITIONS OF SALE. - The right to cut and remove the timber will be sold generally in accordance with the provisions of the State Forests Act, 1908, the Timber Regulations made thereunder, and the following conditions, and may contain such additional conditions as the Commissioner in his discretion considers necessary in the interests of the Crown or of the public.
- The quantities of the various timbers set forth in the above Schedule are approximate only, and are furnished for
the information of intending purchasers, who are expected, previous to the sale, to make their own estimates of the quantities. No contract for purchase shall be voidable, nor shall the licensee be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than stated herein, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein. - The successful bidder shall purchase the whole of the timber and shall on the fall of the hammer pay in cash a deposit equal to 10 per cent. of the amount bid, together with a license fee of £l ls. He shall also deposit nineteen promissory notes for the balance of the purchase-money, including interest at 5 per cent., each payment on demand, and endorsed by two persons to be approved by the Conservator. These promissory notes will be presented for payment, the first at an interval of nine months from the date of sale, and the others at subsequent intervals of six months, but they may be presented at earlier dates if more than a due proportion of timber is found to be cut, or should any breach of the conditions occur, or if in the opinion of the Conservator the interest of the Crown is jeopardized. A proportionate rebate in interest will be allowed in the event of the promissory notes being negotiated before due date of payment.
- The license shall be for a term of ten years from the date of sale, but this term may be extended by the Commissioner should there, in his opinion, be satisfactory reasons for so doing. During the term of the license the purchaser shall have the right to cut and remove all the timber sold on the land. The license shall be for the cutting and removal of the timber, and shall give no right to the use of the land.
- The timber shall be cut in a face, and the Crown reserves the right of following up the mill-workings by felling and grassing such areas as from time to time will have been cleared of milling-timber. Sufficient timber shall be left for fencing and general farming purposes.
- The license shall be subject to any rights of tramway already granted or that may be hereafter granted over the lands comprised therein; and the Commissioner of State Forests may authorize the laying-down and working of tram-lines through the land by other persons than the licensee.
- The license shall be subject to the right of persons engaged in mining operations to deposit tailings on the land.
- The licensee shall not put, throw, or place, or allow to be put, thrown, or placed, into any river, stream, or watercourse, or into any place where it may be washed into any river, stream, or watercourse, any sawdust or other sawmill refuse.
- The licensee shall have no right to compensation for damage to timber that may result from mining operations.
- If the timber is unsold at auction the right to cut it at the upset price will remain open for application until further notice.
- None of the timber which will be cut on the land shall be exported from New Zealand.
- The lot will be sold generally in accordance with the area and boundaries as shown on the sale map at the District Lands and Survey Office, Hokitika.
- No compensation will be given nor shall any be claimed for any error, discrepancy, or misdescription whatever in respect of this lot or in these conditions.

NOTICE is hereby given, in pursuance of section 326 of the Land Act, 1908, that the undermentioned land will be disposed of for cash to the owner of adjoining land, under section 14 of the Land Laws Amendment Act, 1912, on and after Thursday, the 18th day of March, 1920.
