Wairarapa Electric-power Board.—First Election.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of April, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, in pursuance of the powers vested in the Governor-General by section three of the Electric-power Boards Act, 1918, the Wairarapa Electric-power District was duly constituted by Proclamation dated the twenty-third day of March, one thousand nine hundred and twenty:

And whereas section ten of the said Act provides that the first election of representatives of any constituent district in any electric-power district shall be held on such day as the Governor-General by Order in Council appoints:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by the said Act, doth hereby appoint Friday, the seventh day of May, one thousand nine hundred and twenty, as the day on which shall be held the first election of representatives of the constituent districts in the said Wairarapa Electric-power District.

Portions of the Western Side of Morley Street and of the Southern Side of Powderham Street, in the Borough of New Plymouth, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of April, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the New Plymouth Borough Council, the local authority having control of the portions of streets described in the Schedule hereto, has passed the following resolution—viz., “That the New Plymouth Borough Council, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that part of the western side of Morley Street to which Section 287, New Plymouth, has frontages, nor to that part of the southern side of Powderham Street to which Sections 286 and 287, New Plymouth, have frontages”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the portions of the western side of Morley Street and the southern side of Powderham Street described in the Schedule hereto:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned.

SCHEDULE.

ALL that portion of Morley Street, situated in the Borough of New Plymouth, adjoining or passing through Section 287, Town of New Plymouth: also all that portion of Powderham Street, situated in the Borough of New Plymouth, adjoining or passing through Sections 286 and 287, Town of New Plymouth.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 48293, deposited in the office of the Minister of Public Works at Wellington, in the Land District of Wellington, and thereon coloured red.

Revoking the Naturalization of George Lewis Bittelmeyer.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of April, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS letters of naturalization were issued to George Lewis Bittelmeyer on the tenth day of November, one thousand eight hundred and ninety-six:

And whereas the Governor-General in Council is satisfied that it is expedient for the welfare of the Realm to revoke the naturalization of the said George Lewis Bittelmeyer:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Revocation of Naturalization Act, 1917, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the naturalization of the said George Lewis Bittelmeyer shall be revoked, and that the said George Lewis Bittelmeyer shall cease to be a British subject naturalized in New Zealand as from the twenty-second day of April, one thousand nine hundred and twenty.

Validating Proceedings in connection with a Loan of £500 proposed to be raised by the Council of the County of Raglan.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of April, 1920.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Raglan County Council lately proposed to raise a loan of five hundred pounds for the purpose of completing the metalling of the Harapepe—Te Rore Road, under the Local Bodies’ Loans Act, 1913:

And whereas an irregularity or defect occurred both in the notice published in pursuance of section nine of the said Act and in the voting-paper used at the poll upon the said proposal, in that the term of the said loan (namely, thirty-six years and a half) was not set forth in such notice and voting-paper:

And whereas it appears that the ratepayers have not been misled by such irregularity or defect, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the term of the said loan had been stated in the said notice and voting-paper, and that the proceedings shall not be called into question by reason only of the irregularity or defect aforesaid.
