Consenting to the Raising of Loans by certain Local Authorities.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this twelfth day of April, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section twenty, subsection one, of the Finance Act, 1919, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf), whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor-General in Council:

And whereas application has been made for the consent of the Governor-General in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the sums set out therein:

And whereas it is expedient that the precedent consent of the Governor-General in Council should issue:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the raising of the loans hereinafter mentioned by the several local authorities set out in the Schedule hereto, provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Finance Act, 1919, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the loans hereby authorized.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the raising of the loans of three thousand nine hundred and fifty pounds and six thousand four hundred and fifty pounds respectively by the Tauranga Borough Council, provided that the rate of interest at which the loans are to be raised shall in no case produce to the lender a return exceeding five and one-half pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Finance Act, 1919, and shall operate accordingly as a consent of the Governor-General in Council to the raising of the loans hereby authorized.

Closing St. Barnabas Cemetery, Stoke.

ORDER IN COUNCIL.

At the Government House at Wellington, this twelfth day of April, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it appears to the Governor-General that burials in St. Barnabas Cemetery, Stoke, which said cemetery is described in the Schedule hereto, should be wholly discontinued: And whereas a sufficient cemetery not within the limits of any borough or town district has been provided, and has been prepared for the interment of the dead, as required by the Cemeteries Act, 1908:

Now, therefore, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council of the Dominion of New Zealand, and in pursuance of the authorities vested in him by the said Cemeteries Act, 1908, doth hereby order and direct that, from and after the first day of May, one thousand nine hundred and twenty, the St. Barnabas Cemetery, Stoke, described in the aforesaid Schedule, shall be closed, and burials therein discontinued; and, further, that the said cemetery shall, from and after the said first day of May, one thousand nine hundred and twenty, be vested in the Nelson Diocesan Trust Board, under the provisions and for the purposes of the seventy-eighth section of the said Cemeteries Act, 1908.

SCHEDULE.

ST. BARNABAS CEMETERY, STOKE.

ALL that area in the Nelson Land District, containing by admeasurement 3 roods 38·7 perches, more or less, and being part of Section 50, Suburban South Original District, in Block IV, Waimea Survey District. Commencing at a point on the south-eastern side of the main road from Stoke to Nelson, distant 419·5 ft. in a north-easterly direction from the south-western corner of the aforesaid Section 50, Suburban South Original District; thence bounded towards the north-westward by the before-mentioned road, 180 ft., and extending back in a rectangular block a distance of 240 ft.: be all the aforesaid dimensions more or less. As the same is delineated on the plan marked L. and S. 23/540, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Gratuities for Conveyance of Mails by Passenger Coaches or other Vehicles.

ORDER IN COUNCIL.

At the Government House at Wellington, this twelfth day of April, 1920.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section thirty-nine of the Post and Telegraph Act, 1908, as amended by subsection three of section eight of the Post and Telegraph Amendment Act, 1919 (hereinafter termed “the said Acts”), the Governor-General in Council is empowered to determine the amount of gratuities to be paid to the proprietors of passenger coaches or other vehicles for the conveyance of mails:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby determine that the gratuities to be paid to the proprietors of passenger coaches or other vehicles for the conveyance of mails shall be according to the scale set forth in the Schedule hereto; and doth hereby declare that this Order in Council
