And notice is hereby further given that the plan of the land so required to be taken is deposited in the post-office at Puketotara, and is there open for inspection; and that all persons affected by the execution of the said public work or by the taking of the said land should, if they have any well-grounded objections to the execution of the said public work or to the taking of such land, set forth the same in writing, and send such writing, within forty days from the first publication of this notice, to the Minister of Public Works at Wellington.

Fatal Accident, Dominion Mine, Wakamarina.—Notice of Suspension of Mine-manager's Certificate.

WHEREAS the Warden's Court at Blenheim held an inquiry on the 23rd day of February, 1920, before Mr. P. L. Hollings, S.M., Warden, and Thomas Sullivan and Mark Fagan, Assessors, into the fatal accident to Leonard Humphries at the Dominion Mine at Wakamarina on the 14th day of December, 1919:

Now, therefore, after hearing the evidence of witnesses and visiting and inspecting the mine in company with the Inspector of Mines and Mr. James Carroll, the Mine-manager, notice of the following judgment is given by the Warden to the Minister of Mines in terms of subsection (8) of section 266 of the Mining Act, 1908:—

"That there has been non-observance by Mr. Carroll, the holder of the mine-manager's certificate, of the provisions of the Act in the following respects,—

"(1.) That the rise was not properly timbered as required by subsection (11) of section 254 of the Act;

"(2.) That ladders were not provided in the rise as required by subsection (43) of the same section;

"(3.) That these breaches should have been recorded in the Mines Report-book under section 254 (44) for the information of the Inspector, and were not so recorded. The entries made by him in the book were untruthful.

"That by these breaches the Mine-manager, Mr. Carroll, was guilty of negligence, which was the cause of the accident, and his certificate must be suspended for three months.

"25th February, 1920.
