The South-eastern Side of Portion of Frederick Place, in the City of Auckland, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifth day of March, 1920.

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:
And whereas the Auckland City Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That the Auckland City Council doth hereby declare that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the portion of Frederick Place fronting Lots part 1 and 4/5 of a subdivision of Allotments 12/13, Section 44, City of Auckland”:
And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the south-eastern side of the said portion of street subject to the condition hereinafter mentioned:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the south-eastern side of the said portion of street within a distance of twenty-five feet of the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side of portion of Frederick Place, situated in the North Auckland Land District, City of Auckland, adjoining part Lots 1, 4, and 5 of Allotments 12 and 13, Section 44. As the said portion of street is more particularly delineated on the plan marked P.W.D. 47395, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
ALL that portion of Halifax Street, in the Nelson Land District, City of Nelson, situated between Tasman Street and the Maitai River. As the said portion of street is more particularly delineated on the plan marked P.W.D. 47934, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Vesting a Reserve in the Matamata Town Board.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this fifth day of March, 1920.

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto has been duly set apart for cemetery purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Matamata Town Board:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section four of the Public Reserves and Domains Act, 1908, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Matamata Town Board, in trust, for cemetery purposes.
SCHEDULE.
ALL that area in the Auckland Land District, containing by admeasurement 2 acres, more or less. being Section 112A, Block II, Tapapa Survey District (Matamata Settlement). Bounded towards the north-east by a public road; towards the south-east by Section 109, Block II. Tapapa Survey District; and towards the south-west and north-west by Section 112 of said Block II. As the same is delineated on the plan marked L. 1593/4, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.

IN pursuance and exercise of the powers and authorities vested in me by the Animals Protection Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, do hereby appoint those parts of the said Dominion described in the Schedule hereto to be a district under and for the purposes of the said Act.
