Validating Proceedings in connection with the Raising of a Loan of £7,500 by the Council of the County of Waitomo.
LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-fifth day of February, 1920.
Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.
WHEREAS the Waitomo County Council lately proposed to raise a loan of seven thousand five hundred pounds, under the provisions of section sixteen (e) of the Local Bodies’ Loans Act, 1913, for the purpose of forming, culverting, and metalling roads:
And whereas the public notification of the special order authorizing the raising of the loan does not comply with the provisions of section ninety-seven of the Counties Act, 1908, and the amendments thereto, inasmuch as public notification was not given of the time and place fixed for the meeting for the confirmation of the special order:
And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though public notification of the special order had been given in the proper manner, and that the proceedings shall not be called into question by reason only of the irregularity aforesaid.
