His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council dated the twenty-fifth day of February, one thousand nine hundred and nineteen, and gazetted the sixth day of March, one thousand nine hundred and nineteen, prohibiting all alienation of the Native land specified in the Schedule hereto other than alienation in favour of the Crown.

SCHEDULE.

PART Block 3, Nuhaka Crown-grant District, being the land known as Waikokopu No. 3 Native Reserve: Approximate area, 476 acres 3 roods; Nuhaka Survey District.

Waverley Street, in the Borough of Richmond, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-fifth day of February, 1920.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General, by Order in Council, thinks fit to impose :

And whereas the Richmond Borough Council, being the local authority having control of the street described in the Schedule hereto, has passed the following resolution—viz., “That the Richmond Borough Council declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Waverley Street between Gladstone Road and Hart and Washbourn’s frontage” :

And whereas it is deemed expedient that such resolution should be approved :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street, situated in the Nelson Land District, Borough of Richmond, known as Waverley Street, adjoining or passing through Sections 25 and 26, Waimea East, Block VII, Waimea Survey District. As the said street is more particularly delineated on the plan marked P.W.D. 47680, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

Portion of Bidwill Street, in the Borough of Timaru, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

And whereas the Timaru Borough Council, the local authority having control of the portion of street described in the Schedule hereto, hereinafter referred to as the said portion of street, has passed the following resolution—viz., “That the Timaru Borough Council declares that the provisions of section one hundred and seventeen (one) of the Public Works Act, 1908, shall not apply to that portion of Bidwill Street (previously known as Chester Street) to the west of York Street, in the Borough of Timaru” :

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building, or part of a building, shall be erected at any time on either side of the said portion of street within a distance of thirty-three feet of the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of Bidwill Street, in the Canterbury Land District, Borough of Timaru, adjoining or passing through Allotments 30, 44, 45, and Allotment 28 and part R.S. 1766. As the said portion of street is more particularly delineated on the plan marked P.W.D. 48019, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Validating Proceedings in connection with the Raising of a Loan of £2,500 by the Council of the County of Waitomo.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-fifth day of February, 1920.

Present :

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS the Waitomo County Council lately proposed to raise a loan of two thousand five hundred pounds, under the provisions of section sixteen (e) of the Local Bodies’ Loans Act, 1913, for the purpose of forming, culverting, and metalling roads :

And whereas the public notification of the special order authorizing the raising of the loan does not comply with the provisions of section ninety-seven of the Counties Act, 1908, and the amendments thereto, inasmuch as public notification was not given of the time and place fixed for the meeting for the confirmation of the special order :

And whereas the ratepayers’ consent given under subsection (e) of section sixteen aforesaid is irregular, inasmuch as certain subscribing ratepayers have witnessed the signatures of other subscribers thereto :

And whereas it appears that the ratepayers have not been misled by such irregularities, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings taken to raise the said loan shall be valid to all intents and purposes as though public notification of the special order had been given in the proper manner, and as though the ratepayers’ consent to the raising of the loan had been properly witnessed, and that the proceedings shall not be called into question by reason only of the irregularities aforesaid.
