The Southern Side of Portion of O'Neill Street, in the City
of Auckland, exempted from the Provisions of Section 117
of the Public Works Act, 1908, subject to a Condition as to
the Building-line.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this fifth day of
August, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection one of section one hundred
and seventeen of the Public Works Act, 1908, it is,
inter alia, provided that the said section shall not apply in
any case where the local authority having control of a
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or to
any specified part thereof, and such resolution is approved by
the Governor-General in Council:

And whereas by subsection two of section one hundred and
seventeen of the Public Works Act, 1908, and clause (b) of
subsection one of section thirteen of the Public Works Amend-
ment Act, 1911, it is provided that such approval may be
either absolute or subject to such conditions with respect to
the building-line as the Governor-General by Order in Council
thinks fit to impose, and may refer to one or both sides of the
road or street:

And whereas the Auckland City Council, the local autho-
rity having control of the portion of street described in
the Schedule hereto, hereinafter referred to as the said
portion of street, has passed the following resolutionβ€”viz.,
"That the provisions of section one hundred and seventeen of
the Public Works Act, 1908, shall not apply to so much
of O'Neill Street as fronts Lots 47, 48, and 49 of Allotment
29, Section 8, Suburbs of Auckland, subject, however, to the
condition that the building-line on the said lots be set back
a distance of ten feet from the existing road-line":

And whereas it is deemed expedient that such resolution
should be approved in so far as it refers to the southern
side of the said portion of street, subject to the condition
hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the above-in-part-recited Acts, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution to the extent hereinbefore mentioned, subject
to the condition that no building or part of a building shall
be erected at any time on the southern side of the said
portion of street within a distance of ten feet of the existing
street boundary.

SCHEDULE.

THE southern side of all that portion of O'Neill Street,
situated in the North Auckland Land District, City of Auck-
land, adjoining Lots 47, 48, and 49, D.P. 209, of part Allot-
ment 29 of Section 8, Suburbs of Auckland. As the said
portion of street is more particularly delineated on the plan
marked P.W.D. 45827, deposited in the office of the Minister
of Public Works at Wellington, in the Wellington Land
District, and thereon coloured blue.

Declaring Portions of Roads in the Uraura Loan Block,
Matamata County, to be County Roads.

ORDER IN COUNCIL.

At the Government House at Wellington, this fifth day of
August, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by
the Public Works Act, 1908, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that
the portions of roads described in the Schedule hereto shall,
on and after the date of this Order in Council, become
county roads.

SCHEDULE.

ALL that portion of the Cambridge-Taupo Road, situated
in the Auckland Land District, Matamata County (Uraura
Loan Block), commencing at its junction with Wawa Road,
proceeding thence generally in a north-westerly direction for
a distance of 141 chains, more or less, and passing through
Tokoroa No. 2 Block, Blocks XVI and XII, Patetere South
Survey District.

Also all that portion of the Wawa Road, situated in the
said land district, county, and loan block, commencing at
its junction with Cambridge-Taupo Road, and proceeding
thence generally in a south-westerly direction for a distance
of 193 chains, and passing through portion of the Tokoroa
No. 2 Block, Block XVI, Patetere South Survey District.

Also all that portion of the Matarawa Road, situated in
the said land district, county, and loan block, commencing
at its junction with a public road near the junction of the
Cambridge-Taupo and Wawa Roads in Block XVI, Patetere
South Survey District, and proceeding thence generally in
a north-easterly direction for a distance of 310 chains, and
passing through the Tokoroa No. 2 Block, Blocks XVI and
XII, Patetere South Survey Districts, and Block V, Ngau-
tuku Survey District.

As the said portions of roads are more particularly de-
lineated on the plan marked P.W.D. 46494, deposited in
the office of the Minister of Public Works at Wellington, in
the Wellington Land District, and thereon coloured red.

Declaring Portion of the Opotiki-Motu Track, in the Opotiki
County, to be a County Road.

dule hereto shall, on and after the date of this Order in
Council, become a county road.

SCHEDULE.

ALL that portion of road in the Auckland Land District,
Opotiki County, known as the Opotiki-Motu Track, com-
mencing at the Porangahau Saddle (a point near the north-
western corner of Section 2, Block II, Urutawa East Survey
District), and proceeding generally in a north to north-
westerly direction, adjoining or passing through Whitikau
No. 2 Block and Section 2, Block VIII, Urutawa Survey
District, and terminating at its junction with the Whitikau
Road about twenty chains east of the south-western corner
of Section 1, Block VIII, Urutawa Survey District; being
a distance of five miles, more or less. As the said portion of
road is more particularly delineated on the plan marked
P.W.D. 46501, deposited in the office of the Minister of
Public Works at Wellington, in the Wellington Land District,
and thereon coloured red.
