Declaring Land taken for a Public Work, and not required for
such Public Work, to be Crown Land.

[l.s.] A PROCLAMATION.

WHEREAS it is provided by section thirty of the Public
Works Act, 1908, that if it is found that any land
held, taken, purchased, or acquired at any time under this
or any other Act or Provincial Ordinance, or otherwise how-
soever, for any public work is not required for such public
work the Governor-General may, by an Order in Council
publicly notified and gazetted, cause the same to be sold
under the conditions therein mentioned:

And whereas it is further provided by section five of the
Public Works Amendment Act, 1909, that in the case of any
land so taken, purchased, or acquired for a Government
work and not required for that purpose the Governor-General
may, on the recommendation of the Minister, and without
complying with any other requirements of the aforesaid
section thirty, by Proclamation declare such land to be
Crown land subject to the Land Act, 1908, and thereupon
the land may be administered and disposed of under that
Act accordingly:

And whereas the land described in the Schedule hereto
was taken for the purpose of a road: And whereas such
road has been stopped, and it is desirable to declare the land
contained therein to be Crown land:

And whereas a plan has been prepared, and the Minister
has recommended the Governor-General to declare such land
to be Crown land:

Now, therefore, in pursuance and exercise of the powers
and authorities conferred upon me by the above-in-part-
recited Acts, and of all other powers in anywise enabling
me in this behalf, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New
Zealand, do hereby declare the land described in the Schedule
hereto to be Crown land subject to the Land Act, 1908, and
that such land may be administered and disposed of under
that Act accordingly.

SCHEDULE.

APPROXIMATE area of the piece of stopped road declared to
be Crown land: 3 roods 32 perches.
Adjoining or passing through Sections 109 and 78, Block I,
St. Bathan’s District.

In the Otago Land District; as the same is more par-
ticularly delineated on the plan marked P.W.D. 45744,
deposited in the office of the Minister of Public Works at
Wellington, in the Wellington Land District, and thereon-
coloured green.

Given under the hand of His Excellency the Right
Honourable Arthur William de Brito Savile,
Earl of Liverpool, Member of His Majesty’s
Most Honourable Privy Council, Knight Grand
Cross of the Most Distinguished Order of Saint
Michael and Saint George, Knight Grand Cross
of the Most Excellent Order of the British
Empire, Member of the Royal Victorian Order,
Knight of Grace of the Order of Saint John of
Jerusalem, Governor-General and Commander-
in-Chief in and over His Majesty’s Dominion
of New Zealand and its Dependencies; and
issued under the Seal of the said Dominion,
at the Government House at Wellington, this
twenty-third day of July, in the year of our Lord
one thousand nine hundred and nineteen.

Defining the Middle-line of a Further Portion of the East Coast
Main Trunk Railway (namely, Taneatua Section).

WHEREAS the portions of the East Coast Main Trunk
Railway from Pongakawa to Taneatua and from
Taneatua to Opotiki (hereinafter termed “the said railway”)
are portions of a railway the construction of which is autho-
rized by the Railways Authorization Act, 1913, and the Rail-
ways Authorization Act, 1915, respectively:

And whereas the said railway has been partly constructed,
and it has been determined to construct and maintain a
further portion of the said railway:

Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New
Zealand, in pursuance and exercise of the powers and autho-
rities conferred upon me by the Public Works Act, 1908, and
of every other power and authority in anywise enabling me
in this behalf, do hereby proclaim and declare that the
middle-line of the said further portion of the said railway
shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point in Section 90, Block VIII, Rangitaiki
Upper Survey District, marked 92 miles, which point is also
the termination of the railway described in a Proclamation
dated the 4th day of April, 1916, and published in the New
Zealand Gazette No. 38, pages 966 and 967, of the 6th day of
the same month; proceeding thence generally in a south-
easterly direction for a distance of nine miles, and passing
in, into, through, or over the following lands, &c.—viz.,
Section 90, Block VIII, Rangitaiki Upper Survey District;
Section 38, Blocks VIII, Rangitaiki Upper, and IV, Whaka-
tane Survey Districts; Section 31, Blocks IV and VIII,
Whakatane Survey District; Section 32, Blocks VIII and
IX, Whakatane Survey District; Sections 18, 15, 16, 17, 20,
7, 8, 10, Block IX, Whakatane Survey District; and ter-
minating at a point in the said Section 10 marked 101 miles,
and distant about 48½ chains in a south-easterly direction
from the south-eastern corner of Section 8, Block IX, Whaka-
tane Survey District: including all adjoining and inter-
vening places, lands, reserves, roads, tracks, lakes, rivers,
streams, and watercourses: all in the Auckland Land Dis-
trict. As the same is delineated on the plan marked P.W.D.
40885, deposited in the office of the Minister of Public Works
at Wellington, in the Wellington Land District.

extension in the City of Wellington.

LIVERPOOL, Governor-General.
[l.s.] A PROCLAMATION.

WHEREAS the land described in the Schedule hereto
is required to be taken, under the Public Works Act,
1908, for a certain public work—to wit, for the purposes
of street-widening and street-extension in the City of Wel-
ington:

And whereas the Wellington City Council has laid before
the Governor-General a memorial, accompanied by a map
(in duplicate) and also the statutory declaration, as required
by the said Act:

Now, therefore, I, Arthur William de Brito Savile, Earl
of Liverpool, the Governor-General of the Dominion of New
Zealand, in pursuance and exercise of the powers and autho-
rities vested in me by the Municipal Corporations Act, 1908,
the Wellington City Empowering Acts, 1897, 1899, and 1908,
and the Public Works Act, 1908, and of every other power
and authority in anywise enabling me in this behalf, do
hereby proclaim and declare that the land described in the
Schedule hereto is hereby taken for the purposes of the
said street-widening and street-extension, and shall vest in
the Mayor, Councillors, and Citizens of the City of Wel-
ington as from the date hereinafter mentioned; and I do
also declare that this Proclamation shall take effect on and
after the sixteenth day of August, one thousand nine hun-
dred and nineteen.
