Amending Regulations as to Shipment and Landing of Petroleum.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eleventh day of March, 1919.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the ninth day of December, one thousand nine hundred and eighteen, and published in the New Zealand Gazette No. 163, of the twelfth day of the same month, regulations were made with respect to the landing, shipping, transshipping, and removal of petroleum:

And whereas by Order in Council dated the fourth day of February, one thousand nine hundred and nineteen, and published in the New Zealand Gazette No. 15, of the thirteenth day of the same month, additional regulations were made amending the aforesaid regulations:

And whereas it is desirable to make new regulations in substitution for the regulations of the fourth day of February, one thousand nine hundred and nineteen:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by section thirty-three of the War Legislation and Statute Law Amendment Act, 1918, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations amending the regulations of the ninth day of December, one thousand nine hundred and eighteen (hereinafter called “the said regulations”), which shall be read with and form part of such regulations, and shall be in substitution of the amending regulations of the fourth day of February, one thousand nine hundred and nineteen.

REGULATIONS.

  1. CLAUSE 4 of the said regulations is amended by omitting paragraph (1), and substituting the following, viz.:

“(1.) On such vessel entering the port, and so long as the vessel remains in port with more than 2,000 gallons of petroleum on board the master shall, between sunrise and sunset, display at the masthead a red flag of not less size than 24 in. square, and shall, between sunset and sunrise, when his vessel is at anchor, display at the masthead a red light; and whilst the vessel is berthed at any wharf use a red light for his gangway lamp.”

By omitting paragraph (2), and substituting the following, viz.:

“(2.) On or before the arrival in port of any oversea vessel the master or owner shall inform the Harbourmaster of the quantity of petroleum on board, and of the manner in which it is stowed.”

By inserting, in paragraph (3), the words “of every vessel” between the words “master” and “shall” in the first line.

  1. Clause 6 of the said regulations is amended by omitting paragraph (a), and substituting the following, viz.:

“(a.) The holds or spaces in which such petroleum is to be stowed are separated from all other spaces in which cargo may not be stored (such as engine and boiler rooms, crews quarters, passengers quarters, and galley) by watertight or airtight bulkheads, or by other means approved in writing by a Surveyor of Ships.

“Where other cargo is carried in the same hold with petroleum, it shall be stowed in such manner as to avoid damaging the receptacles containing the petroleum.”

Clause 6 is further amended by omitting paragraph (b).

  1. Clause 11 of the said regulations is amended by adding thereto the following words — viz., “or other person appointed for the purpose.”

11A. No person shall take a steam locomotive moving by its own power into the vicinity of a vessel loading or discharging petroleum, or down or up a wharf at which such a vessel is lying, whilst she is engaged in loading or discharging petroleum, unless each locomotive is fitted with effective spark-arresters.

11B. No person shall couple a wagon containing petroleum directly on to a locomotive, but shall put at least two wagons which do not contain petroleum between them.

12A. The Minister may, if he thinks fit, and upon such conditions (if any) as he thinks fit to impose, suspend the operation of any of these regulations, either generally or only so far as vessels of any specified class or size are concerned.

12B. On the annual survey of a ship the Surveyor of Ships shall, if required by the master or owner to do so, issue a certificate as to the vessel’s fitness to carry petroleum. Such certificate shall be issued subject to the condition that it may be withdrawn at any time if the Minister or Surveyor deems it necessary to do so.

  1. Clause 13 of the said regulations is amended by inserting the words “not exceeding” between the word “of” and the figures “£100.”

Amending Regulations under the Land and Income Tax Act, 1916.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eleventh day of March, 1919.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by section one hundred and sixty-three of the Land and Income Tax Act, 1916 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend, in the manner set forth in the Schedule hereto, the regulations under the said Act made by Order in Council dated the seventh day of May, one thousand nine hundred and seventeen, and published in the New Zealand Gazette of the seventeenth day of May, one thousand nine hundred and seventeen.

SCHEDULE.

CLAUSE 2 of the said regulations is hereby revoked, and the following substituted therefor:

“2. The office of the Receiver of Land-tax and Income-tax shall be open daily to the public for the transaction of business from 9.30 a.m. to 12.30 p.m., and 1.30 p.m. to 3.30 p.m., except on public holidays and Saturdays. On Saturdays the office shall be open from 9.30 a.m. to 11.30 a.m.”

Amending Salmon and Trout Fishing Regulations.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this eleventh day of March, 1919.

Present:

WHEREAS by Orders in Council dated the twenty-first day of September, one thousand nine hundred and seventeen, the thirteenth day of January, one thousand nine hundred and eighteen, the eighth day of April, one thousand nine hundred and eighteen, and the twenty-first day of January, one thousand nine hundred and nineteen, and published in the New Zealand Gazette of the twenty-first day of September, one thousand nine hundred and seventeen, the seventh day of February, one thousand nine hundred and eighteen, the eleventh day of April, one thousand nine hundred and eighteen, and the thirtieth day of January, one thousand nine hundred and nineteen, regulations were made for fishing for salmon and trout in salmon rivers:

And whereas it is desirable to amend such regulations:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section eighty-three of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation.

REGULATION.

THE holder of a trout-fishing license may fish for salmon and trout in any river up to and including the thirtieth day of April, one thousand nine hundred and nineteen; provided that no person shall take or catch more than six salmon in any one day.
