Declaring Land taken for a Public Work, and not required for such Public Work, to be Crown Land.

A PROCLAMATION.

WHEREAS it is provided by section thirty of the Public Works Act, 1908, that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise however, for any public work is not required for such public work the Governor-General may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions therein mentioned:

And whereas it is further provided by section five of the Public Works Amendment Act, 1909, that in the case of any land so taken, purchased, or acquired for a Government work and not required for that purpose the Governor-General may, on the recommendation of the Minister, and without complying with any other requirements of the aforesaid section thirty, by Proclamation declare such land to be Crown land subject to the Land Act, 1908, and thereupon the land may be administered and disposed of under that Act accordingly:

And whereas the land described in the Schedule hereto was taken for the purposes of a road: And whereas such road has been stopped, and it is desirable to declare the land contained therein to be Crown land:

And whereas a plan has been prepared, and the Minister has recommended the Governor-General to declare such land to be Crown land:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by the above-in-part-recited Acts, and of all other powers in anywise enabling me in this behalf, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, do hereby declare the land described in the Schedule hereto to be Crown land subject to the Land Act, 1908, and that such land may be administered and disposed of under that Act accordingly.

SCHEDULE.

APPROXIMATE area of the piece of stopped road declared Crown land: 3 roods 33·1 perches.

Adjoining or passing through Section 305, E.R. (Pukeatua Parish), Block III, Waitemata Survey District. (S.O. 20008.)

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 45181, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Member of His Majesty’s Most Honourable Privy Council, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Knight Grand Cross of the Most Excellent Order of the British Empire, Member of the Royal Victorian Order, Knight of Grace of the Order of Saint John of Jerusalem, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this seventh day of March, in the year of our Lord one thousand nine hundred and nineteen.

Police-gaol proclaimed.

A PROCLAMATION.

WHEREAS by the Prisons Act, 1908, it is enacted that the Governor-General may, by Proclamation, declare that such police-stations as he shall name therein shall be police-gaols:

And whereas it is desirable to proclaim the police-station situated at Whakatane to be a police-gaol:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance of the power and authority conferred upon me by the said Act, and of every other power and authority enabling me in this behalf, do hereby proclaim and declare that, from and after the gazetting of this Proclamation, the police-station situated at Whakatane shall be a police-gaol.

Prison proclaimed.

A PROCLAMATION.

WHEREAS by an Act of the General Assembly of New Zealand intituled the Prisons Act, 1908, it is provided that the Governor-General may, by Proclamation published in the Gazette, declare any house, building, enclosure, or place to be a prison, and from and after the gazetting of any such Proclamation, or from any time later specified in the Proclamation, such house, building, enclosure, or place shall be deemed a prison:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance of the above-recited power and authority, do hereby declare that the area of land described in the Schedule hereto, and all buildings and enclosures used or occupied thereon, shall, from and after the date of the publication of this Proclamation in the Gazette, be a prison known as the Wi Tako Prison, within the meaning and for the purposes of the Prisons Act, 1908.

SCHEDULE.

ALL that piece of land in the Wellington Land District, containing by admeasurement 362 acres 1 rood 27 perches, more or less, situated in Block I, Rimutaka Survey District, and being parts of sections numbered 96, 100, 104, 105, 106, 108, and 206, Upper Hutt Registration District. Bounded towards the north-west by the railway reserve, and generally towards the east, south, and west by other parts of the aforesaid sections. As the said piece of land is more particularly delineated on a plan numbered 40/19, deposited in the office of the Chief Surveyor at Wellington, and thereon edged purple.
