Portion of Washington Avenue in the City of Wellington exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-fifth day of February, 1919.
Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General, by Order in Council, thinks fit to impose:
And whereas the Wellington City Council, being the local authority having control of the portion of street described in the Schedule hereto, has passed the following resolution—viz., “That the Wellington City Council, being the local authority having control of the streets in the City of Wellington, hereby declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Washington Avenue, in the said city”:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
ALL that street situated in the Wellington Land District, City of Wellington, known as Washington Avenue, commencing at its junction with Mills Road, and proceeding thence generally in a northerly direction to its termination at the Town Belt, excepting those portions of the said street which were exempted by Orders in Council published in the New Zealand Gazette Nos. 28 and 73, of the 9th day of April, 1908, and the 10th day of June, 1915, and deposited in the Land and Deeds Registry Office at Wellington as Nos. 379 and 728 respectively. As the said portion of street is more particularly delineated on the plan marked P.W.D. 44894, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Revoking Order in Council licensing Thomas Lodge to use and occupy a Part of the Foreshore and Land below Low-water Mark at Russell, Bay of Islands, as a Site for a Wharf and Sheds.

WHEREAS by Order in Council dated the eighth day of November, one thousand nine hundred and fifteen, and published in the New Zealand Gazette No. 128, of the eleventh day of the same month, Thomas Lodge, of Russell, was licensed to use and occupy a part of the foreshore and land below low-water mark of the Bay of Islands, at Russell, for the purpose of erecting a wharf and sheds thereon:
And whereas it is desirable that the said license should be revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the eighth day of November, one thousand nine hundred and fifteen, and the rights and privileges thereby conferred.

Revoking the Vesting in the Chairman, Councillors, and Inhabitants of the Ashburton County of Gravel-pit Reserve 1604, Block XI, Westerfield Survey District, Canterbury Land District.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this twenty-fifth day of February, 1919.
Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto was vested in the Chairman, Councillors, and Inhabitants of the Ashburton County, in trust, as a reserve for a gravel-pit, by an Order in Council dated the twentieth day of January, one thousand eight hundred and eighty, and published in Gazette of the twenty-ninth day of that month, in pursuance of section six of the Public Reserves Act Amendment Act, 1878, but a certificate of title has not issued in respect of the said reserve:
And whereas it is expedient that the said Order in Council should be revoked in so far as it relates to the said land, and the Ashburton County Council has duly consented to such revocation:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection two of section three of the Public Reserves and Domains Amendment Act, 1914, doth hereby revoke the Order in Council hereinbefore referred to so far as it relates to the land described in the Schedule hereto.
SCHEDULE.
ALL that area in the Canterbury Land District, containing by admeasurement 5 acres, more or less, being Reserve 1604, situated in Block XI, Westerfield Survey District, bounded as follows: Towards the north by Lot 2, D.P. 3821, 1000 links; towards the east by Lagmhor Road, 500 links; and towards the south and west by Lot 2, D.P. 3821, 1000 links and 500 links. As the same is delineated on the plan marked L. and S. 22/2319, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.

At the Government Buildings at Wellington, this twenty-fifth day of February, 1919.

WHEREAS the lands described in the Schedule hereto have been duly set apart for gravel depots: And whereas, in the opinion of the Governor-General, it is expedient that the said lands should be vested in the Chairman, Councillors, and Inhabitants of the Taranaki County:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section four of the Public Reserves and Domains Act, 1908, doth hereby declare that, from and after the day of the date hereof, the reserves described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the Taranaki County, in trust, for gravel depots.
