Nos. 3224, 3710, and 3718, situated in Blocks VIII and XII, Rangiora Survey District. Bounded towards the north by the production in a south-east direction of the southern boundary of Rural Section No. 2931 to the road reserved along high-water mark; towards the east by the aforementioned road, a distance of about fifty chains; towards the south by a line at right angles to the general direction of the coast, about nineteen chains; towards the east by the west boundary of the Beach Reserve, twenty chains distant from high-water mark; towards the south by Reserve No. 807; towards the west generally by Rural Section No. 34845, a road-line, Rural Sections Nos. 11318, 11316, 13758, a road-line, the stream forming the eastern boundary of Reserve No. 709, and by the road having a frontage on Rural Sections Nos. 17713 and 17716: save and except two roads and a drain reserve, each one chain wide, passing through the above-described area: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 1/232, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Directing Sale of Railway Land under the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-second day of September, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor-General may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas the piece of land described in the Schedule hereto has been acquired for the purposes of the Kaipara-Waikato Railway:

And whereas the said piece of land is not now required for the purposes of the said Kaipara-Waikato Railway, and the Minister of Railways has recommended that this Order in Council should be issued directing such parcel of land to be sold:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the said land.


SCHEDULE.

APPROXIMATE area of the piece of land: 3 acres 0 roods 33 perches.

Portion of railway reserve (part Allotment 34, Parish of Pukekohe), Block III, Onewhero Survey District, Franklin County. (S.O. 20483, blue.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked W.R. 26583, deposited in the office of the Minister of Railways at Wellington, and thereon coloured purple.

Extending Prohibition of Alienation of certain Native Land other than Alienation in favour of the Crown.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-ninth day of September, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section,

His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council dated the first day of October, one thousand nine hundred and eighteen, and gazetted the third day of October, one thousand nine hundred and eighteen, prohibiting all alienation of the Native land specified in the Schedule hereto, or of any subdivisions thereof, other than alienation in favour of the Crown.

Licensing William Hawea Kirkpatrick to use and occupy a Part of the Foreshore and Land below Low-water Mark at Kohukohu, Hokianga Harbour, as a Site for a Boat-shed.

ORDER IN COUNCIL.

At the Government House at Wellington, this twenty-ninth day of September, 1919.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), William Hawea Kirkpatrick (hereinafter called “the licensee”) has applied to the Governor-General in Council for a license under the said Act to occupy a part of the foreshore and land below low-water mark at Kohukohu, Hokianga Harbour, as a site for a boat-shed; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited a plan (in duplicate) in the office of the Marine Department at Wellington, marked M.D. 5040, showing the area of foreshore and land below low-water mark intended to be occupied, and the manner in which it is proposed to erect the said boat-shed:

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor-General in Council:

And whereas it is expedient that a license should be granted and issued to the licensee under the said Act for the purpose aforesaid on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore and land below low-water mark on which the said boat-shed is to be erected as shown on the plan M.D. 5040, so deposited as aforesaid, for the purpose of erecting and maintaining the said boat-shed; such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.


SCHEDULE.

  1. In these conditions the term “Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to that part of the foreshore and land below low-water mark necessary for the construction of the boat-shed, as shown on plan marked M.D. 5040.

  3. In consideration of the concessions and privileges granted by this Order in Council the licensee shall, on being supplied with a copy thereof, pay to the Minister the sum of £2 10s., and thereafter an annual sum of £2 10s., payable in advance, dating from the date hereof, the first of such annual payments to be made on the licensee being supplied with a copy of this Order in Council.
