Extending Prohibition of Alienation of certain Native Land other than Alienation in favour of the Crown.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this second day of July, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of six months the Order in Council dated the thirtieth day of July, one thousand nine hundred and seventeen, and gazetted the ninth day of August, one thousand nine hundred and seventeen, prohibiting all alienation of the Native land specified in the Schedule hereto other than alienation in favour of the Crown.

Norfolk Downs Drainage District, County of Piako, constituted.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this second day of July, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

WHEREAS, in accordance with the provisions of the third section of the Land Drainage Act, 1908, a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the County of Piako, have presented a petition to His Excellency the Governor-General of the Dominion of New Zealand, praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of the Land Drainage Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I of the said Act, and to be called by the name of the “Norfolk Downs Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees of the said district shall consist of five persons to be elected as members of the said Board and under and in accordance with the said Act.

SCHEDULE
NORFOLK DOWNS DRAINAGE DISTRICT.

ALL that area in the Auckland Land District, being the Mangaotupua Block, and situated in Block IX, Maungakawa Survey District, commencing at the intersection of the south-western boundary of Section 8, Kuranui Block, and the Waitakaruru Stream, and bounded towards the north-east by the south-western boundaries of Section 8 aforesaid and Section 7, Kuranui Block, to the north-western boundary of Tahuaroa Block numbered 1081; thence towards the south-east and south-west generally by Tahuaroa Block and by Tahuaroa No. 3 and No. 4 to the western boundary of the Piako County; thence again towards the south-west by the last-mentioned county boundary to the centre of the Waitakaruru Stream; and towards the north-west generally by that stream to the place of commencement.

Port Chalmers Fire District constituted.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this second day of July, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

WHEREAS by section four of the Fire Brigades Act 1908 (hereinafter termed “the said Act”), it is provided that the Governor-General may by Order in Council, on the application of any Borough Council, declare the district within the jurisdiction of such Borough Council to be a fire district under the said Act: And whereas an application has been made by the Port Chalmers Borough Council in accordance with the provisions of the said Act, and it appears expedient to grant the said application:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare the Borough of Port Chalmers to be a fire district under the said Act.

The Northern Side of Portion of Hill Street, in the Borough of West Harbour, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this second day of July, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the West Harbour Borough Council, the local authority having control of the portion of street described in the Schedule hereto, has passed the following resolution—viz., “That this Council declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to Hill Street (being a street within this borough over which this Council as local authority has control) from Bishop’s Street to Athol Place, both streets within this borough”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the northern side of the said portion of street, subject to the condition herein-after mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building, or part of a building, shall be erected at any time on the northern side of the said portion of street within a distance of thirty-three feet of the centre-line of the said portion of street.

SCHEDULE.

THE northern side of that portion of Hill Street, in the Otago Land District, Borough of West Harbour, fronting part Section 56, Block IX, North Harbour and Blueskin District, and Allotments 1 to 6, Block I, Upper Rothesay. As the said portion of street is more particularly delineated on the plan marked P.W.D. 44125, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.
