Revoking Part of a Proclamation taking Land for Quarry Purposes in Blocks XI and XII, Patetere North Survey District.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue or making of any Proclamation or Order in Council taking land under the Public Works Act, 1908, and before* the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation or Order in Council or the making or gazetting thereof, the Governor-General may, by a subsequent Proclamation or Order in Council gazetted, revoke the former Proclamation or Order in Council either wholly or so far as he thinks necessary:

And whereas it is found that part of the land taken for quarry purposes in Blocks XI and XII, Patetere North Survey District, by a Proclamation made under the Public Works Act, 1908, dated the ninth day of April, one thousand nine hundred and eighteen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 55, page 1071, of the eighteenth day of the same month, is incorrectly described:

And whereas compensation in respect of the land taken by the said Proclamation has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke so much of the said Proclamation as affects that portion of land, containing 1 acre 1 rood 13 perches, described in the said Proclamation as Lot 3 of 105, Block XII, Patetere North Survey District (S.O. 19312).

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Member of His Majesty’s Most Honourable Privy Council, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor-General and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twelfth day of June, in the year of our Lord one thousand nine hundred and eighteen.

Declaring Portion of Kokako Road, in the Kaitieke County, to be a County Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this tenth day of June, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of road in the Wellington Land District, Kaitieke County, known as the Kokako Road, commencing at a point twenty-four chains south of the southern boundary of Section 2, Block XIII, Kaitieke Survey District, and continuing thence generally in a southerly direction along the boundary between Sections 3 and 6, Block XIII aforesaid, and terminating at the northern boundary of Section 5 of the said Block XIII, Kaitieke Survey District; being a distance of forty-four chains, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 44256, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured blue.

Declaring Portion of Whitikau Track, in the Opotiki County, to be a County Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this tenth day of June, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.

SCHEDULE.

ALL that portion of road in the Auckland Land District, Opotiki County, known as Whitikau Track, commencing at its junction with the Opotiki–Motu Track, a point on the southern boundary of Section 1, Block VIII, Urutawa Survey District, and extending thence generally, first in an easterly, and then in a northerly direction, following the western bank of the Whitikau Stream, adjoining or passing through Section 1, Block VIII, Urutawa Survey District, and Section 5, Block IV, Urutawa Survey District, and terminating at a point near the south-eastern corner of Section 3, Block IV, Urutawa Survey District; being a distance of six miles, more or less. As the said portion of road is more particularly delineated on the plan marked P.W.D. 44245, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Declaring Portion of Road in Block I, Tutaki Survey District, to be a Government Road.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this tenth day of June, 1918.

Present:

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a Government road.

SCHEDULE.

APPROXIMATE area of the piece of road declared a Government road: 1 acre 0 roods 27 perches.
Adjoining or passing through Sections 91 and 92, Square 138, Block I, Tutaki Survey District (Nelson R.D.).

In the Nelson Land District; as the same is more particularly delineated on the plan marked P.W.D. 43239, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured green.
