2190 THE NEW ZEALAND GAZETTE. [No. 85

Validating Proceedings in connection with a Loan of £1,200
proposed to be raised by the Mangere Road Board for Water-
supply.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this tenth
day of June, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING
IN COUNCIL.

WHEREAS the Mangere Road Board lately proposed to
raise a loan of three thousand pounds under the
Local Bodies’ Loans Act, 1913, for the purpose of providing
a water-supply to part of the Mangere Road District:
And whereas an irregularity or defect occurred in the
notice published by the Chairman of the said Board setting
forth the day and place on which the poll of the ratepayers
to vote on the said proposal would be held, inasmuch as the
first of the four of such notices specified the offices of the said
Board at Mangere as the place for such poll, but the three
succeeding notices specified the Mangere Bridge School as
such place, and the said poll was duly taken at the said
Mangere Bridge School:
And whereas it appears that the ratepayers have not been
misled by such irregularity or defect, and it is expedient to
validate the same:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Execu-
tive Council of the said Dominion, doth hereby declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the Mangere
Bridge School had been stated as the place for the poll in the
first notice published in pursuance of subsection two of
section ten of the Local Bodies’ Loans Act, 1913, and that
the proceedings shall not be called into question by reason
only of the irregularity or defect aforesaid.

J. F. ANDREWS,
Clerk of the Executive Council.

Validating Proceedings in connection with a Loan of £700
proposed to be raised by the Upper Wangaehu Road Board.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this tenth
day of June, 1918.

Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING
IN COUNCIL.

WHEREAS the Upper Wangaehu Road Board lately
proposed to raise a loan of seven hundred pounds
under the Local Bodies’ Loans Act, 1913, for the purpose
of providing its share of the cost of constructing a portion
of the Taihape-Mataroa Road:
And whereas the resolution making and levying the special
rate as security for the said loan is irregular in that such
resolution was passed before the special order authorizing the
raising of the loan was gazetted, as required by section
seventy-three of the Road Boards Act, 1908:
And whereas the public notices of the special order autho-
rizing the raising of the loan, although four publications were
made, were not given once in each of the four weeks immedi-
ately preceding the day on which the special order was con-
firmed, inasmuch as no public notice was given in the third
week, as required by section seventy-two of the Road Boards
Act, 1908:
And whereas it appears that the ratepayers have not been
misled by such irregularities, and it is expedient to validate
the same:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred on him by section one
hundred and eleven of the Local Bodies’ Loans Act, 1913,
and acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby declare that the
proceedings taken to raise the said loan shall be valid to all
intents and purposes as though the resolution making and
levying the special rate as security for the said loan had been
passed at the proper time, and as though the requirements
of section seventy-two of the Road Boards Act, 1908, as
above mentioned, had been strictly complied with, and that
the proceedings in connection with the said loan shall not be
called into question by reason only of the irregularities afore-
said.

J. F. ANDREWS,
Clerk of the Executive Council.
