The South-western Side of Brown’s Road, in the City of Christchurch, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this thirtieth day of April, 1918.

Present:

His Excellency the Governor-General in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions with respect to the building-line as the Governor-General by Order in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Christchurch City Council, the local authority having control of the street described in the Schedule hereto, hereinafter referred to as “the said street,” has passed the following resolution — viz., “The Christchurch City Council, being the local authority having control of Brown’s Road in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the south-west side of said road”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the south-western side of the said street, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building or part of a building shall be erected at any time on the south-western side of the said street within a distance of thirty-three feet of the original centre-line of the said street.

SCHEDULE.

The south-western side of all that street in the Land District of Canterbury, City of Christchurch, known as Brown’s Road, situated between Innes Road and St. Albans Lane.

As the said street is more particularly delineated on the plan marked P.W.D. 44022, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Portions of Avoca and Reynolds Streets, Maryhill Terrace Extension Road, and Portion of Leckhampton Court, in the City of Dunedin, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

At the Government House at Wellington, this seventh day of May, 1918.

His Excellency the Governor-General in Council.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor-General in Council:

And whereas the Dunedin City Council, the local authority having control of the portions of streets described in the Schedule hereto, has passed the following resolution—viz., “That the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the streets or portions of streets shown on plan hereunto annexed, and thereon coloured red, the said streets or portions of streets being not less than forty feet in width, and abutting on to that land being part of subdivision into allotments by Mr. John McDonald of (inter alia) part Section 65, Block VI, Town District of Dunedin”:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portions of Avoca Street, Reynolds Street, and Maryhill Terrace Extension Road within a distance of thirty-three feet from the centre-line of the said portions of such streets, and within a distance of 19·7 links from the north-western side of the portion of Leckhampton Court, described in the Schedule hereto.

SCHEDULE.

ALL that portion of Avoca Street, in the Otago Land District, City of Dunedin, adjoining or passing through part of Section 65, Block VI, Town District (including Allotment 13 on L.T. plan No. 2750), and Allotments 43, 122, and part 123 of the Glen Estate.

Also all that portion of Reynolds Street, in the said land district and city, adjoining or passing through part Section 65, Block VI, Town District, and Allotments 3, 4, and 13, L.T. plan 2750, and Allotments 55 and 58, Caversham Rise, shown on L.T. plan No. 191.

Also all that portion of street known as Maryhill Terrace Extension Road, in the said land district and city, adjoining or passing through Allotments 1, 2, 7, 6, and 8, 9, 10, 11, and 12 on L.T. plan No. 2750, and part Allotment, 5 Caversham Rise, shown on L.T. plan No. 169.

Also all that portion of street known as Leckhampton Court, situated in the said land district and city, adjoining Allotments part 6 and 5 on L.T. plan 2750.

As the said street and portions of streets are more particularly delineated on the plan marked P.W.D. 43413, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Land District, and thereon coloured red.

Prohibiting all Alienation of certain Native Land other than Alienations in favour of the Crown.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this seventh day day of May, 1918.

Present:

His Excellency the Governor-General in Council.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prohibit, for the period of one year from the date of this Order in Council, all alienations of the Native lands specified in the Schedule hereto other than alienations in favour of the Crown.
