Directing Sale of Railway Land under the Public Works Act, 1908.

LIVERPOOL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this thirtieth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

WHEREAS by the thirtieth section of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work the Governor-General may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas the parcel of land described in the Schedule hereto has been, inter alia, taken for the purposes of the Hurunui–Waitaki Railway (branch from the Washdyke to Opawa, Fairlie Creek, and Burke’s Pass):

And whereas the said parcel of land is not now required for the purposes of the said Hurunui–Waitaki Railway (branch from the Washdyke to Opawa, Fairlie Creek, and Burke’s Pass), and the Minister of Railways has recommended that this Order in Council should be issued directing such parcel of land to be sold:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the land described in the Schedule hereto.

SCHEDULE.

Approximate area of the piece of land: 37 acres 2 roods 32 perches. (S.O. 243v, red.)

Portion of railway reserve (R S 6192 and part R.S. 6191). Block XI, Tengawai Survey District, Mackenzie County.

In the Canterbury Land District; as the same is more particularly delineated on the plan marked W.R. 25479, deposited in the office of the Minister of Railways at Wellington, and thereon edged green.

Domain Board appointed to have Control of the Patea Domain.

ORDER IN COUNCIL.

At the Government House at Wellington, this thirtieth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

WHEREAS by section forty of the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor-General may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to Part II of the said Act, control of such domain:

And whereas by an Order in Council made on the twenty-fourth day of April, one thousand nine hundred and eleven, and published in the New Zealand Gazette of the fourth day of May, one thousand nine hundred and eleven, a Domain Board was appointed to control the Patea Domain:

And whereas the period for which the said Board was appointed expired on the twenty-third day of April, one thousand nine hundred and eighteen:

And whereas it appears expedient to again appoint a Domain Board to control the said domain:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

JOSEPH HENRY CRONIN,
FREDERICK GEORGE DAVIES,
EDWARD FREDRIC HENRY HEMINGWAY,
CHARLES ALBERT LARCOMBE, and
CHARLES MCKELLAR STROUTS

to be the Patea Domain Board, having control of the land described in the Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby

appoint Monday, the twenty-seventh day of May, one thousand nine hundred and eighteen, at half past seven o’clock p.m., as the time when, and the Borough Council Chambers, Patea, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

PATEA DOMAIN.

All that area in the Taranaki Land District, containing by admeasurement 65 acres 2 roods 25 perches, more or less, being Blocks Nos. XLIV and XLV, Town of Patea, Block VII, Carlyle Survey District. Bounded towards the north by a road, 1326·1 links; generally towards the east by a road, Rutland Street, Middlesex Street, Surrey Street, and Egmont Street, 4670·2 links; generally towards the south by Section 73, Block VII aforesaid, 2000 links; and generally towards the west by Sections 50 and 51, Block VII aforesaid, 3921 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. 1130, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Extending Prohibition of Alienation of certain Native Lands other than Alienations in favour of the Crown.

ORDER IN COUNCIL.

At the Government House at Wellington, this thirtieth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, and by section one hundred and eleven of the Native Land Amendment Act, 1913 (as amended by section eight of the Native Land Amendment and Native Land Claims Adjustment Act, 1916), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby extend for a further period of eighteen months the Order in Council dated the twentieth day of November, one thousand nine hundred and sixteen, and gazetted the twenty-third day of November, one thousand nine hundred and sixteen, prohibiting all alienations of the Native lands specified in the Schedule hereto other than alienations in favour of the Crown.
