Regulations relating to Spirits.

LIVERPOOL, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this sixteenth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers and authorities conferred on him by the Sale of Food and Drugs Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend, in the manner set forth in the Schedule hereto, the regulations made under the said Act on the fourth day of March, one thousand nine hundred and thirteen, and published in the Gazette of the sixth day of the same month; and doth hereby declare that this Order in Council shall come into force on the eighteenth day of April, one thousand nine hundred and eighteen.

SCHEDULE.

  1. PARAGRAPH 49 of Part II of the regulations aforesaid (relating to the standard strength of spirits) is hereby revoked, and the following paragraph substituted therefor:—

“49. STANDARD OF STRENGTH OF SPIRITS.

“The standard of strength of spirits which, whether before or after the coming into operation of this regulation, have been imported into New Zealand shall be as follows :—

“(a.) Brandy, whisky, or rum imported into New Zealand in bottles or jars in cases shall not be of a less strength than 25 degrees under proof.

“(b.) Brandy, whisky, or rum imported into New Zealand otherwise than in bottles or jars in cases shall not be of a less strength than 35 degrees under proof.

“(c.) Gin shall not be of a less strength than 35 degrees under proof.”

  1. Nothing in this Order in Council shall affect the provisions of an Order in Council dated the same day prohibiting the importation into New Zealand of any brandy, whisky, or rum of a less strength than 25 degrees under proof.

Validating Proceedings in connection with a Loan of £1,200 proposed to be raised by the Stratford County Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this sixteenth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

WHEREAS the Stratford County Council, acting under and in pursuance of paragraph (e) of section sixteen of the Local Bodies’ Loans Act, 1913, lately proposed to raise a loan of one thousand two hundred pounds for the purpose of forming and metalling the Waihapa Road from the end of the present metal to the Wingrove Road :

And whereas the ratepayers’ consent given under paragraph (e) of section sixteen aforesaid is irregular in that one of the subscribing ratepayers has attested the signatures of other subscribers thereto :

And whereas it appears that the ratepayers have not been misled by the said irregularity, and it is expedient to validate the same :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eleven of the Local Bodies’ Loans Act, 1913, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the ratepayers’ consent to the raising of the said loan shall be valid to all intents and purposes as though the same had been properly witnessed, and that the validity of the proceedings in connection with the said loan shall not be called into question by reason only of the irregularity aforesaid.

Revoking Order in Council licensing Hubert Henry Dacre to use and occupy a Part of the Foreshore of Mangonui Harbour as a Site for a Boat-slip.

ORDER IN COUNCIL.
At the Government House at Wellington, this eighth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

WHEREAS by Order in Council dated the second day of August, one thousand nine hundred and nine, and published in the New Zealand Gazette No. 65, of the twelfth day of the same month, Hubert Henry Dacre (hereinafter called “the licensee”) was licensed to use and occupy a part of the foreshore of Mangonui Harbour for the purpose of erecting a boat-slip: And whereas it is desirable that the said license should be revoked :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the second day of August, one thousand nine hundred and nine, and the rights and privileges thereby conferred.

Vesting the Control of a Travelling-stock Reserve in the Cook County Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this sixteenth day of April, 1918.

Present :

His Excellency the Governor-General in Council.

WHEREAS the land described in the Schedule hereto has been duly set apart as a resting-place for travelling stock: And whereas it is expedient that the control of the said reserve should be vested in the Cook County Council :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section two of the Public Reserves and Domains Amendment Act, 1914, doth hereby vest the control of the said reserve in the Cook County Council, subject, however, to the following conditions :—

(1.) The said reserve shall at all times be available for the accommodation of travelling stock.

(2.) The said Council shall, within a period of eighteen months from the date hereof, clear, grass, and fence the said reserve for the purpose of providing grazing and accommodation for travelling stock.

(3.) The charges for grazing and paddocking stock shall not exceed two shillings per hundred head for sheep and twopence per head for cattle.

(4.) Provision shall be made for keeping different flocks of sheep and herds of cattle separate as far as possible.

(5.) Except under stress of weather, or in cases where roads are temporarily impassable, no stock which has been accommodated in the reserve for one night and one day shall be permitted to remain therein for any longer period if other stock requires accommodation which could not otherwise be provided except by the removal of the stock already in the reserve.

(6.) Except for the purpose of consuming feed running to waste and keeping the pasture in good order, no stock other than travelling stock, and one horse as may be required for the use of any caretaker appointed by the said Council, shall be permitted to graze within the boundaries of the said reserve.

SCHEDULE.

ALL that area in the Hawke’s Bay Land District, containing by admeasurement 1 acre 1 rood 16 perches, more or less, being Section 20, Block XV, Waikohu Survey District. Bounded towards the north-west by a public road, 269 links; towards the north-east by Section 23, Block XV aforesaid, 151·6 and 438·9 links; towards the south-east by Crown lands, 176·5 links; and towards the south-west by Crown
