First Meeting, Wanganui Fire Board.

THE following special order, made by the Mangaorongo Road Board, is published in accordance with the provisions of the Road Boards Act, 1908.

MANGAORONGO ROAD BOARD.

TRAFFIC ON ROADS BY-LAW, 1918.

In pursuance and exercise of powers vested in the Board by the Road Boards Act, 1908, and its amendments, and by the Public Works Act, 1908, and its amendments, and every other power it thereto enabling, the Mangaorongo Road Board makes and ordains this by-law.

  1. This by-law may be cited or referred to as “The Traffic on Roads By-law, 1918,” and shall come into force on the 7th day of November, 1918.

  2. In this by-law, except where inconsistent with the context,—
    “Clerk” means the Clerk of the Mangaorongo Road Board:
    “Board” means the Mangaorongo Road Board:
    “Road district” means the Mangaorongo Road District:
    “Inspector of Vehicles” means the person for the time being appointed by the Board to inspect vehicles for the purposes of this by-law; and if there be no such person for the time being, then the expression shall mean the “Clerk”:
    “Motor” means any vehicle propelled by mechanical means:
    “Horse vehicle” means any vehicle drawn or intended to be drawn by one or more horses:
    “Owner” of any vehicle includes a bailee thereof entitled to the use and possession or profits of such vehicle:
    “Heavy traffic” means heavy traffic as defined by section 139 of the Public Works Act, 1908.

A vehicle shall be deemed to ply for hire for the carriage of passengers or goods whenever on any road or public place the driver or person in charge of such vehicle engages, offers, or solicits to carry any passengers or any goods for a money payment to or from any place within the Road District of Mangaorongo.

  1. No person, being the owner, driver, or person in charge of any vehicle, shall cause or permit the same to ply for hire for the carriage of passengers or goods in the road district, or any part thereof, unless such vehicle be licensed under this by-law and have thereon a number-plate as in this by-law provided.

  2. The owner of any vehicle desiring to use the same to ply for hire for the carriage of passengers or goods within the road district, or any part thereof, may apply to the Clerk for a license for such vehicle. The application shall be in writing, and shall state:—
    (a.) The description of the vehicle;
    (b.) The number of horses or other means of traction to be employed;
    (c.) The maximum number of passengers or the maximum weight of the load to be carried; and
    (d.) The full name, occupation, and address of the owner.

On receipt of any such application the Clerk shall cause the vehicle therein mentioned to be inspected by the Inspector of Vehicles. If the Inspector be satisfied that the vehicle is a fit and proper one for carriage of passengers or goods, as the case may be, and that suitable accommodation is provided for the passengers or goods to be carried, the Clerk may issue a license for such vehicle on payment of the prescribed fee. The license shall be signed by the Clerk, and shall state the particulars referred to in clauses lettered (a), (b), (c), and (d) as enumerated in this section or paragraph. Every license shall be in force from the date of issue till the 31st day of December following; provided that, in the case
