REGULATIONS.

THE master of every British ship engaged in the coasting trade of New Zealand, when proceeding through that part of Cook Strait included within a straight line drawn from Cape Palliser to Cape Campbell, and a straight line drawn from Cape Egmont to Cape Farewell, or when proceeding through the waters within fifty miles of that portion of the northern coast of New Zealand commencing at Cape Brett on the east coast and extending round to Hokianga on the west coast, shall before entering and while passing through the above-mentioned areas have all boats swung outboard with boat-covers off and all gear in readiness for the immediate lowering of the same into the water.

When the master of any such ship finds it impracticable for that ship to proceed with the boats swung outboard as prescribed above, he shall report in writing to this effect to the Superintendent of Mercantile Marine, who shall make an inspection, and, if satisfied that the boats and all other life-saving appliances are ready to be put out and lowered with the utmost despatch, shall give a certificate in writing to that effect, whereupon the last preceding regulation shall not apply to that ship.

The master of any such ship who omits to observe or commits a breach of these regulations is liable to a fine not exceeding £50.

Regulations relating to Pearl-shell Fisheries in the Cook Islands.

ORDER IN COUNCIL.
At the Government House at Wellington, this fourth day of November, 1918.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section fifty-three of the Cook Islands Act, 1915, the Governor-General in Council is empowered to make all such regulations as he thinks necessary for the peace, order, or good government of the Cook Islands:
And whereas it is expedient to make regulations with respect to pearl-shell fisheries in the Cook Islands:
Now, therefore, in pursuance and exercise of the powers conferred on him by the Cook Islands Act, 1915, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations under and for the purposes of the said Act; and doth hereby declare that these regulations shall come into force on the first day of December, one thousand nine hundred and eighteen.
REGULATIONS.
- In these regulations—
“Resident Commissioner” means the Resident Commissioner of Rarotonga:
“Fishing reserve” means any reserve established or set aside for public pearl-shell fishing at the islands of Penrhyn or Manihiki, or hereafter set aside elsewhere within the Cook Islands for that purpose.

No pearl-shell of a diameter of less than 4½ inches shall be taken from any fishing reserve or purchased in or exported from any of the Cook Islands.

No person shall fish or dive for pearl-shell in any fishing reserve unless he is the holder of a license granted under these regulations.

Every such license shall expire on the 31st day of March in each year.

All licenses to use a diving-machine or to fish and dive for pearl-shell shall be in the respective forms in the Schedule hereto, and shall be issued by the Resident Agent.

Every application for a license shall be made in writing to the Resident Agent, who may refuse any application for a license for a diving-machine made by any person not of British birth.

At any fishing reserve diving-machines may be used for diving for pearl-shell for such period in each year and within such limits as may from time to time be appointed by the Island Council (with the approval of the Resident Agent) of the island within which such fishing reserve is situated.

The Island Council of any island in which a fishing reserve is situated with the approval of the Resident Agent may from time to time fix a close season for the whole or any part of such reserve during which it shall not be lawful for any person to fish for pearl-shell in the said reserve, or in any part thereof so closed.

(1.) The following fees shall be payable to the Resident Agent on the issue of licenses under these regulations, and shall form part of the Public Revenues of the Cook Islands:—
(a.) Diving-machine license, per annum, £20.
(b.) Diving and fishing license for a Native other than a Native of the island in which the fishing reserve is situated, per annum, £1.
(c.) Diving and fishing license for a Native of the island in which the fishing reserve is situated, no fee.
(2.) The same fee shall be charged for a license for any portion of a year as for a whole year.

Every person who commits a breach of these regulations is liable to a penalty not exceeding £20, or, in default of payment thereof, to imprisonment with or without hard labour for any term not exceeding three months.

Any of the powers conferred by these regulations upon an Island Council with the approval of a Resident Agent may be exercised by the Resident Commissioner.

NOTE.—Where applicant is a Native of the island in which the fishing reserve is situated, strike out the words “having paid the prescribed fee.”

Appointing a Member of the Otago Harbour Board.
LIVERPOOL, Governor-General.
WHEREAS it is provided by section seventeen of the Harbours Amendment Act, 1910, that the office of any member of a Harbour Board shall become vacant if, inter alia, he dies:
And whereas it is provided by subsection two of section eighteen of the said Act that when an elective member other than a representative of a constituent district vacates his office on the Board through the operation of the said section seventeen the Governor-General may, by Warrant under his hand, appoint some qualified person in his place:
And whereas Alfred Henry Bridger, who was appointed by the Governor-General to be a member of the Otago Harbour Board as a representative of the electors of the Borough of St. Kilda and of the City of Dunedin, is deceased, and it is desirable to appoint some qualified person as a representative of that district in his place:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the hereinbefore-recited power and authority, doth hereby appoint
CECIL FENWICK MITCHELL
to be a member of the Otago Harbour Board as a representative of the electors of the Borough of St. Kilda and of the City of Dunedin, in the place of the said Alfred Henry Bridger, deceased.
As witness the hand of His Excellency the Governor-General, this twenty-ninth day of October, one thousand nine hundred and eighteen.
