Altering the Middle-line of a Portion of the East Coast Main
Trunk Railway — namely, Portion of Wairoa Section
(towards Gisborne).

A PROCLAMATION.

WHEREAS, under the provisions in that behalf of sec-
tion one hundred and eighty-eight of the Public
Works Act, 1908, the middle-line of a portion of the East
Coast Main Trunk Railway—namely, portion of Wairoa
Section (towards Gisborne)—was defined by a Proclamation
dated the eighth day of February, one thousand nine hundred
and sixteen, and published in the New Zealand Gazette No. 15,
of the tenth day of the same month :

And whereas it has been found necessary in the construc-
tion of such railway to alter such line in manner hereinafter
appearing :

Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New
Zealand, in pursuance and exercise of the powers conferred
upon me by the aforesaid section one hundred and eighty-
eight, and of all other powers and authorities enabling me
in this behalf, do hereby revoke the Schedule to the said
Proclamation; and in lieu thereof do hereby proclaim and
declare that the middle-line of the said portion of railway shall
be as defined and set forth in the Schedule hereto.


SCHEDULE.

COMMENCING at a point in Subdivision 2, Paeroa 1B Block,
Block I, Clyde Survey District, marked 0 mile, and pro-
ceeding thence generally in a northerly direction for a dis-
tance of two miles, and passing in, into, through, or over the
following lands, &c.—viz., Subdivisions 2, 3, 4A, 4B, of Paeroa
1B Block, Block I, Clyde Survey District; Subdivisions 12,
11, 10, 9, 7B, 7A, 6, of Paeroa 1E Block, Block I, Clyde Survey
District; Subdivision 2 of Paeroa 1E Block, Blocks I, Clyde,
and XVII, Opoiti Survey Districts; and Subdivision part G 2,
Lot 9, of Paeroa No. 2 Block, Block XVII, Opoiti Survey
District; and terminating at the two-mile peg near the
southern boundary of the said Subdivision part G 2, Lot 9,
of Paeroa 2 Block, which peg is the commencement of the
Proclamation dated the 27th day of March, 1918, described
in Gazette No. 48, of the 4th day of April, 1918; including all
adjoining and intervening places, lands, reserves, roads,
tracks, lakes, rivers, streams, and watercourses: all in the
Land District of Hawke's Bay. As the same is delineated
on the plan marked P.W.D. 44741, deposited in the office of
the Minister of Public Works at Wellington, in the Wellington
Land District.

Crown Land set apart for the Purposes of a Road in Block IX,
Tuhua Survey District.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto
is Crown land, and is required to be set apart for
the purposes of a road in Block IX, Tuhua Survey District:

And whereas by section twenty-one of the Public Works
Act, 1908, it is enacted that whenever any Crown land is
required to be set apart for any public work the Governor-
General may at any time by Proclamation set the same apart
for such public work without complying with any of the pro-
visions of that Act in respect of the taking or setting-apart of
other lands for such purpose:

Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor-General of the Dominion of New Zea-
land, in pursuance and exercise of the powers and authorities
vested in me by the Public Works Act, 1908, and of every
other power and authority in anywise enabling me in that
behalf, do hereby proclaim and declare that the land
described in the Schedule hereto is hereby set apart for the
purposes of a road; and I also hereby declare that this Pro-
clamation shall take effect on and after the ninth day of
November, one thousand nine hundred and eighteen.


SCHEDULE.

APPROXIMATE area of the piece of Crown land set apart:
7 acres 3 roods 23 perches.

Portion of Rangitoto-Tuhua 55A (C.L.), Block IX, Tuhua
Survey District. (S.O. 18476.)

In the Auckland Land District; as the same is more
particularly delineated on the plan marked P.W.D. 44378,
deposited in the office of the Minister of Public Works at
Wellington, in the Wellington Land District, and thereon
coloured pink.

Declaring Land taken for a Public Work, and not required for
such Public Work, to be Crown Land.

A PROCLAMATION.

WHEREAS it is provided by section thirty of the Public
Works Act, 1908, that if it is found that any land
held, taken, purchased, or acquired at any time under this
or any other Act or Provincial Ordinance, or otherwise how-
soever, for any public work is not required for such public
work the Governor-General may, by an Order in Council
publicly notified and gazetted, cause the same to be sold
under the conditions therein mentioned:

And whereas it is further provided by section five of the
Public Works Amendment Act, 1909, that in the case of any
land so taken, purchased, or acquired for a Government
work and not required for that purpose the Governor-General
may, on the recommendation of the Minister, and without
complying with any other requirements of the aforesaid
section thirty, by Proclamation declare such land to be
Crown land subject to the Land Act, 1908, and thereupon
the land may be administered and disposed of under that
Act accordingly:

And whereas the land described in the Schedule hereto
was taken for the purposes of the North Island Main Trunk
Railway: And whereas such land is not now required for
the purpose for which it was taken, and it is desirable to
declare such land to be Crown land:

And whereas a plan has been prepared, and the Minister
has recommended the Governor-General to declare such land
to be Crown land:
