Determining Lease over certain Education Reserve in Hawke’s Bay Land District.
LIVERPOOL, Governor.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this seventh day of May, 1917.
Present:
THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.
WHEREAS by section three of the Education Reserves Amendment Act, 1913 (hereinafter termed “the said Act”), it is, inter alia, enacted that any lease or license which has been theretofore granted by School Commissioners under the Education Reserves Act, 1908, or any former Act relating to education reserves or endowments, and which confers upon the lessee or licensee any right, whether absolute or contingent, to a renewal of the lease or license, whether on the same or different terms and conditions, may be at any time determined by the Governor by Order in Council if the Land Board reports to the Minister that the land comprised in such lease or license should be subdivided: And whereas the Hawke’s Bay Land Board has reported to the Minister that the lands described in the Schedule hereto should be subdivided:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by section three of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, from and after the seventh day of May, one thousand nine hundred and seventeen, the lease over the lands described in the Schedule hereto shall absolutely cease and determine.

DATE of lease: 10th December, 1896.
Name of lessee: George Hunter.
Land comprised in lease: Lot 2, Block 76, Porangahau, Blocks VII, VIII, XI, XII, Porangahau Survey District.

Domain Board appointed to have Control of the Epsom Domain.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this seventh day of May, 1917.

THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.
WHEREAS by section forty-seven of the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, by Order in Council gazetted, appoint any local authority to be the Domain Board having, subject to the said Act, control of any public domain:
And whereas by an Order in Council made on the fifth day of September, one thousand nine hundred and eleven, and published in the New Zealand Gazette of the seventh day of September, one thousand nine hundred and eleven, the Epsom Road Board was appointed the Epsom Domain Board, having control of the lands described in the Schedule hereto for the purposes of and subject to the provisions of Part II of the said Act:
And whereas by a Proclamation dated the twenty-ninth day of January, one thousand nine hundred and seventeen, and published in the New Zealand Gazette of the first day of February, one thousand nine hundred and seventeen, the Epsom Road District became merged in the City of Auckland, and the Epsom Road Board became thereby non-existent:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the aforementioned Order in Council of the fifth day of September, one thousand nine hundred and eleven, and doth hereby appoint

to be the Epsom Domain Board, having the control of the land described in the Schedule hereto for the purposes of and subject to the provisions of Part II of the said Act; and doth hereby appoint Thursday, the twenty-fourth day of May, one thousand nine hundred and seventeen, at seven o’clock p.m., as the time when, and the Town Hall, Auckland, as the place where, the first meeting of the Board shall be held.

SCHEDULE.
EPSOM DOMAIN.
ALL that area in the Auckland Land District, containing by admeasurement 11 acres 2 roods 16 perches, more or less, being Allotment 182 of Section 10, Suburbs of Auckland (Block I, Otahuhu Survey District). Bounded towards the north-east by Allotment 46, Section 6, Suburbs of Auckland, 1365 links; towards the south-east by Gillies Avenue, 850 links; towards the south-west by Allotment 181, Section 10, Suburbs of Auckland, 1365 links; and towards the north-west by School Road, 850 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. 1427, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.
Also all that area in the Auckland Land District, containing by admeasurement 2 acres 2 roods 36 perches, more or less, being Allotment 180A of Section 10, Suburbs of Auckland (Block I, Otahuhu Survey District). Bounded towards the north-east by Windmill Road and Allotment 69A of Section 10, Suburbs of Auckland, 680 links; towards the south-east by School Road, 534 links; and towards the south-west generally by Windmill Road, 163, 279, 217, 96, and 248 links respectively: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. 1427A, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.
Also all that area in the Auckland Land District, containing by admeasurement 4 acres 3 roods 33 perches, more or less, being Allotment 180 of Section 10, Suburbs of Auckland (Block I, Otahuhu Survey District). Bounded towards the north-east by Allotment 68 of Section 10, Suburbs of Auckland, 800 links; towards the south-east by Allotment 69A of the aforesaid section, 620 links; towards the south-west by Windmill Road, 800 links; and towards the north-west by Allotment 179 of the aforesaid section, 620 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. 1427B, deposited in the Head Office, Department of Lands, at Wellington, and thereon edged red.

Consenting to the Raising of Loans by certain Local Authorities.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this seventh day of May, 1917.

THE HONOURABLE SIR JAMES ALLEN, K.C.B., PRESIDING IN COUNCIL.
WHEREAS by section twenty-six, subsection one, of the Appropriation Act, 1915, it is provided that, notwithstanding any Act to the contrary, it shall not be lawful or competent for any local authority or for any Harbour Board, during the present war with Germany, to borrow or contract to borrow any money (otherwise than by way of bank overdraft within the limit of its powers, if any, in that behalf) whether from the State Advances Office or from any other source whatever, and whether in pursuance of a special Act or under any other authority whatever, without the precedent consent of the Governor in Council:
And whereas application has been made for the consent of the Governor in Council to enable the several local authorities mentioned in the Schedule hereto to borrow the loans set out in column B therein: And whereas it is expedient that the precedent consent of the Governor in Council should issue:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the borrowing of the loans herein-after mentioned by the several local authorities set out in the Schedule hereto; provided that the rate of interest at which the loans or any of them are to be raised shall in no case produce to the lender a return exceeding five and one-quarter pounds per centum per annum; and it is hereby declared that this Order in Council is made under the provisions in that behalf of the Appropriation Act, 1915, and
