Authorizing the Laying-off of a Street in the Borough of Eastbourne of a Width less than 66 ft. but not less than 40 ft.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this sixteenth day of April, 1917.

Present:

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

WHEREAS by section one hundred and seventy-eight of the Municipal Corporations Act, 1908, it is, inter alia, provided that, where the configuration of any borough is such that within any particular area or areas thereof it is difficult or inexpedient to construct streets of a width of sixty-six feet, as required by the said Act, the Governor may, by Order in Council defining the limits of such particular area or areas, authorize the Council to permit within such area or areas the construction of streets or private streets of a width less than sixty-six feet but not less than forty feet:

And whereas the configuration of the Borough of Eastbourne is such that within the area described in the Schedule hereto it is inexpedient to construct a street of a width of sixty-six feet:

Now, therefore, in pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Eastbourne Borough Council to permit, within the area described in the Schedule hereto, the laying-off of a street within the said area of [a width less than sixty-six feet but not less than forty feet.

SCHEDULE.

All that parcel of land situated in the Borough of Eastbourne, Wellington Land District, comprising an area of about 2 roods 14·2 perches, and being part of Sections 37 and 39, Harbour District. As the said land is more particularly delineated on the plan marked P.W.D. 41862, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured green.

Amending the Regulations under the Orchard and Garden Diseases Act, 1908, in regard to the Importation of Fruit or Plants into New Zealand—Notice No. 1877.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this sixteenth day of April, 1917.

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by the Orchard and Garden Diseases Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the regulations under the said Act made by Order in Council on the twenty-third day of August, one thousand nine hundred and fifteen, and published in the Gazette of the second day of September, one thousand nine hundred and fifteen, by adding to the Twelfth Schedule of the the said regulations the words “Aspidiotus destructor transparens”; and doth hereby declare that this Order in Council shall come into force and take effect on the day of the publication hereof in the Gazette.
