Boundaries of Waikiwi River District, County of Southland, altered.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this second day of April, 1917.

Present:

THE HONOURABLE W. H. HERRIES PRESIDING IN COUNCIL.

WHEREAS the Waikiwi River Board, being of the opinion that certain lands situated in the County of Southland, and not included in the Waikiwi River District (hereinafter referred to as “the said district”), are deriving benefit from the river-works carried out by the said Board, did, in accordance with the provisions of section four of the River Boards Amendment Act, 1913 (hereinafter referred to as “the said Act”), present a petition to His Excellency the Governor, praying that the boundaries of the said district might be altered so as to include such lands in the said district:

And whereas in respect thereof a Commission has been appointed to inquire and report as to the several matters mentioned in subsection three of section four of the said Act:

And whereas the Commission so appointed has reported that the lands described in the First Schedule hereto, being part of the County of Southland, should be included in the said district, and ought to become liable for the levy of rates hereafter to be made by the Board, and also for the future levying of rates already made by the said Board:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by section four of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that as on and from the date hereof the boundaries of the said district are hereby altered so as to include in the said district the lands described in the First Schedule hereto, and that the boundaries of the Waikiwi River District shall be those set forth in the Second Schedule hereto; and, with the like advice and consent, doth also direct that the lands so included shall be liable for the levy of rates hereafter to be made by the Board, and also for the future levying of rates already made by the said Board.

FIRST SCHEDULE.

AREAS INCLUDED IN WAIKIWI RIVER DISTRICT.

ALL that area in the Southland Land District, containing by admeasurement 85 acres 1 rood 20 perches, more or less, being Section 35, Block IX, Invercargill Hundred, and closed road intersecting same; and bounded towards the north by a road; towards the east by Section 34 and closed road; towards the south by Sections 27 and 28, Block IV; and towards the west by Section 36 and closed road, Block IX aforesaid.

Also all that area, containing by admeasurement 20 acres 0 roods 8 perches, more or less, being Lots 1, 2, 3, and 4 on Land Transfer plan No. 26, subdivisions of Section 36, and closed road, Block IX, Invercargill Hundred, known as Beaconsfield, and bounded towards the north by Lot 5 of the said Section 36, towards the east by Section 35 and closed road in Block IX aforesaid, towards the south by Section 27 and closed road in Block IV, and towards the west by the main North Road.

Also all that area, containing by admeasurement 34 acres, more or less, being parts of Sections 13, 16, and 18, Block XV, Invercargill Hundred, and bounded towards the north by Sections 119, 120, and 121; towards the east by Section 10, distance 1470 links; towards the south by a right line at right angles to the western boundary of the said Section 10 to Section 11; and thence towards the west by Sections 11, 124, and public road to Section 119, the place of commencement.

SECOND SCHEDULE.

WAIKIWI RIVER DISTRICT.

ALL that area in the Southland Land District, situated in Blocks IV, IX, XIV, XV, XVI, and XVII, Invercargill Hundred. Bounded towards the north-east generally by Section No. 13, Block XVI, from the westernmost corner of that section to the road forming its south-eastern boundary; thence across that road and by Section No. 38 to its south-eastern corner; thence towards the north-west generally by Sections Nos. 38 and 39 to a point on the eastern boundary-line of the last-mentioned section, distant 2511 links from its north-eastern corner; thence towards the north by a right line to a point on the eastern boundary-line of Section No. 42, distant 2543 links from the north-eastern corner of that section; thence across the road forming the eastern boundary of the said Section No. 42; thence towards the west by that road to the north-western corner of Section No. 43, Block XVI aforesaid; thence again towards the north by the road forming the southern boundaries of Sections Nos. 40, 39, 38, and 21, Block XIV, to a point in line with the western boundary-line of Section No. 5; thence towards the west by a line across the last-mentioned road and by the road forming the western boundary of Section No. 5 aforesaid to the north-western corner of that section; thence again towards the north by the road forming the northern boundaries of Sections Nos. 5, 4, 3, and 2, Block XIV, to the north-eastern corner of the last-mentioned section; thence across a road, and towards the west by the road forming the western boundaries of Section No. 27, Block IV, and Section No. 36, Block IX, to Lot 5, said Section No. 36; thence again towards the north by the said Lot 5 to the eastern boundary of Section No. 36, and again towards the west by the last-mentioned section to its north-eastern corner; thence towards the north-east by the road forming the north-eastern boundaries of Sections Nos. 35, 34, 33, 32, and 31, Block IX aforesaid, and towards the east by the road forming the eastern boundary of the last-mentioned section to its south-eastern corner; thence again towards the north across a road and by Sections Nos. 12, 11, and 10, Block IX aforesaid, and again towards the east by Section No. 4, and across the road at the south-western corner of that section; thence again towards the north by the road forming the northern boundary of Section No. 35, Block IV, to its north-eastern corner; thence again towards the east by the road forming the eastern boundaries of Sections Nos. 35 and 26, Block IV, for a distance of 53 chains to the road which intersects the last-mentioned section; thence towards the south by the road which intersects Sections Nos. 26, 25, and 24, and the northern side of that road produced westerly to the eastern boundary of Section No. 1 of 20; thence towards the west by the last-mentioned section and across the road forming its northern boundary; thence again towards the south by the road forming the northern boundaries of Sections Nos. 1 of 20, 19, 18, 17, 16, 15, and 14, Block IV, and across the road forming the western boundary of the last-mentioned section; thence towards the east by the road forming the eastern boundary of Section No. 1, Block XIV, and towards the south by the road forming the southern boundaries of Sections Nos. 1 and 3, Block XIV aforesaid, to the road along the western side of the Invercargill-Kingston Railway; thence again towards the east by that road and the railway reserve to a point on the eastern boundary-line of Section No. 3, Block XV, distant 1500 links from the north-eastern corner of that section; thence again towards the south by a right line to a point on the eastern boundary-line of Section No. 13, distant 1500 links from its north-eastern corner, by that section to a point distant 1470 links from its north-eastern corner, thence by a right line at right-angles to the eastern boundary of that section to Section No. 11, and by that section to its northernmost corner; thence towards the south-east generally by that section, across a road, and by Sections Nos. 12 and 23, Block XV aforesaid, to a point on the northern boundary of the last-mentioned section, distant 620 links from its easternmost corner; thence by a right line to a point on the northern side of the road which intersects Section No 14, distant 615 links from the intersection of the northern side of the said road by the eastern boundary-line of the said Section No. 14; thence across and by the said road to its junction with another road intersecting the said Section No. 14 in a southerly direction; thence by the last-mentioned road to the road forming the south-eastern boundary of Section No. 20, Block XV; thence by that road and the road forming the north-eastern boundary of Section No. 21, Block XVI, to a point in line with the north-western boundary-line of the last-mentioned section; thence across the road and by the said Section No. 21 to its westernmost corner; thence towards the south-west generally by the road forming the south-western boundaries of Sections Nos. 23, 25, 27, and 29, Block XVI, and the road forming the north-western and western boundaries of Section No. 22 to the north-eastern corner of Section No. 14; thence by the said Section No. 14 and the production of its northern boundary-line to the Oreti River; thence towards the west by the Oreti River to the road forming the northern boundary of Section No. 47; thence towards the north-west generally by that road to the north-eastern corner of the said Section No. 47; thence across the road and by Sections Nos. 46 and 8, Block XVI, to the road forming the north-eastern boundary of the last-mentioned section; thence across and by that road and the road along the left bank of the Oreti River to the southernmost corner of Section No. 15; and thence by Sections Nos. 15 and 14, Block XVI aforesaid, to the place of commencement.
